  Annex 1 - Mandatory Conditions

   

  Where licence authorises the supply of alcohol

   

  1.                            No supply of alcohol may be made under the premises licence-

  (a)               at a time when there is no designated premises supervisor in respect of the               premises licence, or

  (b)               at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Door Supervision

   

  Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority.

  Where the licence authorises the exhibition of Films

   

  1.              The admission of children to the exhibition of any film must be restricted in accordance with this section.

   

  2.              Where the film classification body is specified in the licence, unless subsection (3) (b) applies, admission of children must be restricted in accordance with any recommendation made by that body.

   

  3.              Where-               (a)               the film classification body is not specified in the licence, or

  (b)               the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  4.              In this section- "children" means persons aged under 18; and "film classification body" means the person or persons designated as the authority  under section 4 of the Video Recordings Act 1984 (c.39)  (authority to determine suitability of video works for classification).

   

   

  The Licensing Act 2003 (Mandatory Licensing Conditions)

  (Amendment) Order 2014

   

  1.                (1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises-

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-

  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;

  (d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

  (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

   

  2.                The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

   

  3.                (1)  The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

  (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-

  (a) a holographic mark, or

  (b) an ultraviolet feature.

   

  4.                The responsible person must ensure that-

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml;

  (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

  (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

   

   

  Conditions as specified by order of the Secretary of State under S19A of the Licensing Act 2003

  Conditions effective from 28th May 2014

   

  (1)              A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

  (2)              In this condition:-

  (a)              “permitted price” is the price found by applying the formula P = D + (D x V), where-

  (i)              P is the permitted price,

  (ii)              D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  (iii)              V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

  (b)              “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

  (c)              “relevant person” means, in relation to premises in respect of which there is in force a premises licence-

  (i)              the holder of the premises licence,

  (ii)              the designated premises supervisor (if any) in respect of such a licence, or

  (iii)              the personal licence holder who makes or authorises a supply of alcohol under such a licence;

  (d)              “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

  (e)              “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.

  (3)              Where the permitted price would not be a whole number of pennies, the permitted price shall be taken to be the price rounded up to the nearest penny.

  (4)              1) Where the permitted price on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.

  2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

  Annex 2 - Conditions consistent with the Premises Operating Schedule

   

  Conditions offered by applicant

   

  General

   

  A.1              The facilities shall not be used under the terms of the Licence until all the conditions of this licence are complied with.

   

  A.2              The licensee shall ensure that all arrangements for the preparation and conduct of licensed events be in liaison with the Chief Constable, Chief Fire Officer or their delegated Officer and the delegated representatives of Ipswich Borough Council.

   

  A.3              An initial event manual must be submitted to IBC licensing Enforcement no later than 8 weeks prior to any event.  Among other things, this manual must contain:

   

  A.3.1              details of the event management structure including clear descriptions of roles and responsibilities;

   

  A.3.2                            the name and address of the “responsible person” (see A.8);

   

  A.3.3                            a suitable and sufficient health and safety risk assessment for the event;

   

  A.3.4                            a suitable and sufficient fire risk assessment for the event;

   

  A.3.5              a comprehensive description of health, safety and compliance management arrangements;

   

  A.3.6              a comprehensive summary of the security arrangements for the event (see B.4);

   

  A.3.7              a comprehensive summary of the first aid arrangements for the event (see C.16);

   

  A.3.8              details of the lost and found child procedures and arrangements (see E.1);

   

  A.3.9              a detailed site map showing the layout of the event and the location and type of any temporary structures and noise making equipment;

   

  A.3.10                            details of emergency services access arrangements;

   

  A.3.11              a comprehensive summary of the crowd management measures for inside the event;

   

  A.3.12              arrangements for the control of crowds and vehicles outside the premises;

   

  A.3.13              details of the provision of sanitary accommodation for the event (see A.13 to A.16); and

   

  A.3.14              details of communications to be used Radios or Mobile Phones with a directory with key personnel. 

   

  A.4              Following its initial submission, the event manual must be updated to reflect any significant changes to the arrangements it documents.  Where such changes are made, a suitably updated revision of the manual must be submitted to IBC Licensing Enforcement in a timely manner, and no later than 2 working days before the event.

   

  A.5              No variation or alteration shall be made from the arrangements detailed in the most recently submitted version of the event manual without the prior agreement of IBC Licensing Enforcement.

   

  A.6              Any additional works which the Council may reasonably consider necessary shall be carried out to its satisfaction prior to or during the event as appropriate.

   

  A.7              Admission shall be given to authorised officers of the Council*, Health and Safety Executive, Suffolk Fire and Rescue Service and the Police at all reasonable times (including the whole of the licensed period) and to all parts of the premises in order to ensure the compliance with the conditions of this Licence.

   

  *              The authorised officers of the Council will be Building Control Officers, Environmental Health Officers, Environmental Protection Officers, and Licensing Enforcement Officers.

   

  A.8              The licensee, or some responsible person nominated by him in writing for the purposes, shall be in charge of and on the premises during the whole time they are open to the public for licensable activities. The responsible person must hold a personal licence and shall produce his/her written authority on request by an authorised officer of the Licensing Authority, a Police Officer or the Senior Fire Officer present at the event.

   

  A.9              The licensee will ensure that no more than 3 event/concert days will take place at this location per calendar year.  Where 3 separate events take place they will not be on more than 2 consecutive weekends.

   

  A.10              So far as is reasonably practicable, the licensee shall ensure that the event starts promptly at the advertised time.

   

  A.11              The Licensee shall ensure that the total number of persons permitted within the licensed area at any one time does not exceed 39,999.  Certification of the number of tickets sold for any ticketed event must be provided as soon as possible after the event.

   

  A.12              The licensee should ensure that all relevant persons involved in the production and performance are fully aware of the requirements of these conditions.   The licensee shall take appropriate steps to ensure that any person connected with the presentation of the performance, does not breach any condition or restriction of this licence.

   

  A.13              The Event Management Plan for any events held on this licence will be subject to review and scrutiny by the Ipswich Borough Safety Advisory Group at least 2 weeks prior to the start of the event.

   

  [SANITARY ARRANGEMENTS]

               

  A.14              Based on predicted attendance and audience gender ratio, the total provision of sanitary accommodation for use at any event shall be in accordance with the following guidelines:

  For Events with a gate opening time of 6 hours or more              For Events with a gate opening time of less than 6 hours duration

  Female              Male              Female              Male

  1 toilet per 100 females              1 toilet per 500 males, plus 1 urinal per 150 males              1 toilet per 120 females              1 toilet per 600 males, plus 1 urinal per 175 males

   

  A.15              The licensee shall ensure that adequate hand-washing facilities are provided at a ratio of at least one per five toilets provided.

   

  A.16              The licensee shall provide appropriate sanitary accommodation for wheelchair users and other people with special needs attending events.   Where applicable, these facilities should be located in close proximity to any area set aside for the disabled.  Based on predicted attendance, one toilet with hand-washing facilities should be provided per 75 people with special needs.

   

  A.17              The licensee shall ensure, so far as is reasonably practicable, that all hand-washing facilities and sanitary accommodation are adequately stocked with consumables and maintained in a serviceable condition.

   

  [WASTE MANAGEMENT]

   

  A.18              The Licensee shall provide a sufficient number of easily identifiable, readily accessible and adequate receptacles for refuse.  Arrangements shall be made regular collection, and contents are to be to be removed from site by a competent contractor.

   

  The Prevention of Crime and Disorder

   

  [RESPONSIBLE DRINKING]

   

  B.1              All events will adopt the ‘Challenge 25’ policy, only accepting bona fide forms of photographic ID (e.g. ID photo driving licences, passports etc.), which should be requested by a suitably trained person, bar staff or Door Supervisors.

   

  B.2              No beers or ciders with an alcohol by volume content of 6.5% and over shall be sold or supplied at any event.

   

   

   

   

   

  [SECURITY PERSONNEL]

   

  B3              All security personnel, Door Supervisors and Stewards, (excluding volunteer stewards), controlling the security of the event must be fit and capable of carrying out their duties, and hold an appropriate Security Industry Authority licence, (and be in contact with event management by radio or mobile phone).

   

  B4              There will be an appropriate number of Door Supervisors and stewards on duty for the event as agreed with the licensing authority - subject to a suitable risk assessment of needs being undertaken.  On day of event Door Supervisors will search guests for prohibited items. These items will be confiscated and deposited in a place where guests cannot retrieve them.

   

  B5              Door Supervisors and stewards should carry out the six basic duties as stipulated:

   

  B.5.1              to control and assist spectators who are entering or leaving the park;

  where applicable, to assist persons to their seat and to ensure that they are sitting in the correct place;

  B.5.2              to be able to recognise problems that may occur relating to seating difficulties so as to sort out the problem to the customers’ satisfaction;

  B.5.3              to patrol the ground and deal with any emergencies that may arise and in the event of such an emergency take positive action to give an alarm and tackle the problem;

  B.5.4              to staff all entrances and exits from the ground and to staff other strategic points within the park. To ensure that exit gates and doors from the park remain unlocked whilst the event is in progress and until the crowd has left the park;

  B.5.6              to assist the Police or Emergency Services within the licensed area if requested; and

  B.5.7              to undertake specific duties in the event of an emergency which might give rise to the evacuation of the park.

   

  Public Safety

   

  [ACCESS, WORKPLACE TRANSPORT & CROWD MANAGEMENT]

   

  C1              So far as is reasonably practicable, the Licensee must ensure that all traffic routes are:

   

  C.1.1              kept free from obstructions and trip hazards

  C.1.2              clearly signposted; and

  C.1.3              adequately illuminated during periods of darkness.

   

  C2              Adequate access for emergency services shall be provided and maintained both to and within the park throughout the duration of the event as determined by the risk assessment. Such access shall be kept clear of obstructions at all times. A separate telephone shall be provided by the licensee for calling the emergency services.

   

  C3              Stewarding staff must ensure that overcrowding does not occur in any part of the venue by managing and directing the crowd, particularly on entering and leaving the park.  Stewards shall monitor key points for overcrowding.

   

  C4              Suitable notices shall be provided by the Licensee throughout the licensed area to indicate clearly the location of all available services and facilities such as sanitary accommodation, refreshments, drinking water, first aid points etc., all of which shall be clearly signposted.  Additional signage of a larger size should be provided to assist people with exiting the park.

   

  C5               The Licensee must take appropriate steps to ensure that a maximum speed limit of 5mph is observed onsite and that whilst moving within the licensed area all vehicles have their hazard lights switched on.

   

  C6              The Licensee to the satisfaction of the Licensing Authority shall provide public address apparatus, in addition to or being the system used by the performers.

   

  [CATERING]

   

  C7              The Licensee must ensure that a list is submitted to IBC Licensing Enforcement no later than 14 days prior to an event giving details of all food businesses due to be in attendance.  For each business this list must include:

   

  C.7.1              trading name;

  C.7.2              contact details;

  C.7.3              the Local Authority it is registered with;

  C.7.4              its current food hygiene rating (if available);

  C.7.5              whether it will be operating from a temporary structure or a mobile unit; and

  C.7.6              whether it will be using LPG.

   

  C8              Where businesses are operating from mobile units, the electrical installations within these units must have been inspected in accordance with BS7671 within the 12 months preceding an event.  The Licensee must ensure that all businesses using mobile units with fixed electrical installations submit a copy of the most recent periodic inspection report for these installations to IBC Licensing Enforcement no later than 14 days prior to an event.

   

  C9              Where businesses are operating from mobile units equipped with LPG appliances, the gas fixtures and systems within these units must have been inspected within the 12 months preceding an event by a competent person who is gas safety registered for LPG appliances.  The Licensee must ensure that all businesses using LPG equipped mobile units submit a copy of the most recent periodic inspection report for these gas installations to IBC Licensing Enforcement no later than 14 days prior to an event.

   

  [ELECTRICAL INSTALLATIONS]

   

  C10              All parts of the electrical installation systems constructed specifically for the event shall conform in all respects to BS7671. All generators shall be earthed at their neutral point by means of a suitable earth electrode and all systems shall have separate neutral and earth systems (TNS) and shall be sited as near as practicable to the associated electrical installation.

   

  C11              Residual current device(s) shall be mounted as part of the fixed wiring to protect the entire electrical installations. They shall conform to the relevant British/European standard, with no intentional time delay, and have a rated tripping current no greater than 30mA.

   

  C12              The Licensee shall ensure that the electrical installation is installed by competent persons, and is properly maintained and used in a safe manner.

   

  C13              The use of in petrol generators is not permitted within the park.  So far as is reasonably practicable all generators must be located away from members of the public, protected from vandalism and barriered-off.

   

   

   

   

   

  [FAIRGROUND RIDES AND AMUSEMENTS]

   

  C14              Current in-service inspection certificates for all amusement and inflatable amusement devices attending an event must be made available to IBC Licensing Enforcement for inspection prior to the start of the event.  Any operator who fails to produce an appropriate inspection certificate or proof of inspection will not be allowed to trade.

   

  C15              All amusement and inflatable amusement operators attending an event must submit valid public liability insurance certificates to IBC Licensing Enforcement for inspection prior to the start of the event.  Any operator who fails to produce a valid certificate confirming appropriate cover is in place will not be allowed to trade.

   

  [FIRST AID]

   

  C16              A fully equipped first aid point, or points, shall be provided to the satisfaction of the Council, and shall be adequately staffed by trained first aid personnel.  The level and standard of ambulances and medical cover shall be determined by risk assessment and documented in the event manual.

   

  C17              Potable drinking water shall be provided to the satisfaction of the IBC Licensing Enforcement for persons at the event and at First Aid Point(s) and in the pit area.

   

  [GLASS POLICY]

   

  C18              Unless agreed otherwise with IBC Licensing Enforcement, except within the confines of defined corporate hospitality areas, during events the licensed area is to be subject to a no glass policy.  Any request by the Licensee for a relaxation of this policy must be supported by a suitable and sufficient risk assessment (which should consider the nature of the event, the audience profile etc.), the significant findings of which should be documented in the event manual.

   

  C19              Except where a relaxation of the no glass policy has been agreed, the Licensee shall ensure that attendants are advised by advance publicity that no glassware should be brought into the licensed area.

   

  C20              Unless agreed otherwise with IBC Licensing Enforcement, with the exception of loose fitting plastic or paper lids, no drinks may be sold or supplied in closed containers.

   

  [HAZARDOUS SUBSTANCES]

   

  C21              Explosives, flammable liquids, toxic, hazardous or highly flammable substances shall not be brought on to or used at the park without the consent of the Council.

   

  [NOISE EXPOSURE]

   

  C22              In order to minimise the risk of hearing damage to spectators, performers and staff, the peak sound pressure level in any audience area shall not exceed 140dB.

   

  [SPECIAL EFFECTS]

   

  C23              No lasers, strobes, ultra-violet light or other form of high intensity special lighting or fog/smoke machinery shall be installed or used without the prior approval of the Council. No such equipment shall be used other than strictly in accordance with any terms and conditions that may be imposed by the Licensing Authority.

   

  C24              A suitable and sufficient risk assessment for all pyrotechnic displays must be completed and a copy forwarded to IBC Licensing Enforcement at least 14 days prior to the event.

   

  C25              Real flame shall not be used in an entertainment without the prior consent of the Council.

   

  [TEMPORARY STRUCTURES]

   

  C26              The Licensee must ensure that the following information regarding each of the temporary structures to be erect for an event is submitted to IBC Licensing Enforcement no later than 4 weeks prior to that event:

   

  C.26.1                            plans of the proposed structures;

  C.26.2                            details and calculations of ground support and anchorage;

  C.26.3                            details of bracing required in walls and roof;

  C.26.4              calculations proving the design of the structure if a stage, seating, large marquee, screen or rigging, or if requested by the Council;

  C.26.5                            full details of any movable platforms , hoists, lifts etc.;

  C.26.6                            flammability test certificate for fabrics;

  C.26.7              if a stage or platform is raised in excess of 300mm, details of stairs (minimum 2 on opposite sides) giving access to and from stage and handrails to all non performing edges; and

  C.26.8                            Calculations of loadings of all flown equipment.

                             

  C27              The Licensee should discourage the use of pagodas/tents of a domestic type.  Where such structures are used, the Licensee must ensure that they are weighted down or ground anchored in a suitable manor, and are dismantled safely in the event of high winds.

   

  The Prevention of Public Nuisance

   

  [NOISE CONTROLS]

   

  D1              Music will cease at 22:30 hour and will not commence prior to 10:00 hours on any one day.

   

  D2              The terminal hour for the sale and consumption of alcohol on site is 22:00 hours on any one day.  Allowance will be made for an additional 30 minutes drinking up time after the terminal hour for sales of alcohol.

   

  D3              Except for noise propagation tests that have been agreed with IBC Environmental Protection, rehearsals and sound checks will only be permitted after 10:00hrs on the day of the event.

   

  D4              The licensee shall, in consultation with the Ipswich Borough Council, ensure that local residents are made aware of the sound check times and the start and finish of the event times by means of press releases, local radio and leafleting in the locality of the Park 10 days before the event.

   

  D5              The licensee shall nominate a person who is suitably qualified and competent to control noise, to the approval of the Council, no later than 14 days prior to the event.  This nominated person shall liaise between all parties including the Licensee, Promoter, sound system supplier, sound engineer and the Council etc. on all matters relating to noise control prior to and during the event.  Every attempt should be made to avert excess levels of noise during the event.

   

  D6              A noise propagation test shall be undertaken at the earliest opportunity prior to the start of the event in order to set appropriate control limits for the sound mixer position. The sound system shall be configured and operated in a similar manner as intended for the event. The sound source used for the test shall be similar in character to the music likely to be produced during the event.

   

  D7              Throughout the duration of both the event and any rehearsal or sound check, the Licensee must ensure that the noise level due to amplified music and speech does not exceed 75dB LAeq over a 5 minute period at any noise sensitive premises. In addition, levels must not exceed 75dB Leq over a 5 minute period in either the 63Hz or 125Hz octave frequency band.

   

  D8              The Licensee shall ensure that the promoter, sound system supplier and all individual sound engineers are informed of the sound control limits established during the propagation test and that any instructions from the person nominated to control noise regarding noise levels shall be implemented.

   

  D9              The person nominated to control noise shall continually monitor noise levels at the sound mixer position and advise the sound engineer accordingly to ensure that the noise limits are not exceeded. The Licensing Authority shall have access to the results of the noise monitoring at any time.

   

  D10              The Licensee shall take all reasonable measures to ensure that persons attending the event do not cause unreasonable noise or nuisance to local residents on arrival and leaving the premises.

   

  The Protection of Children from Harm

   

  E.1              The Licensee shall provide a bespoke Lost Children area, staffed by appropriately trained CRB checked staff.

   

  Conditions agreed through mediation with Other Person

   

  1.              Adequate access for emergency services shall be provided and maintained both to and within the park throughout the duration of every event as determined by a risk assessment. A traffic management plan will be in place and this document is to be supplied to the Licensing Authority 28 days in advance of each event.
