• ANNEX 1 - MANDATORY CONDITIONS

   

   

  Where licence authorises the supply of alcohol

   

  1.                            No supply of alcohol may be made under the premises licence-

  (a)               at a time when there is no designated premises supervisor in respect of the               premises licence, or

  (b)               at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.                            Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

   

  Door Supervision

   

  Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority.

   

  Where the licence authorises the exhibition of Films

   

  1.              The admission of children to the exhibition of any film must be restricted in accordance with this section.

   

  2.              Where the film classification body is specified in the licence, unless subsection (3) (b) applies, admission of children must be restricted in accordance with any recommendation made by that body.

   

  3.              Where-               (a)               the film classification body is not specified in the licence, or

  (b)               the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  4.              In this section- "children" means persons aged under 18; and "film classification body" means the person or persons designated as the authority  under section 4 of the Video Recordings Act 1984 (c.39)  (authority to determine suitability of video works for classification).

   

   

  Conditions as specified by order of the Secretary of State under S19A of the Licensing Act 2003

   

  Conditions effective from 6th April 2010

   

  1.              (1)               The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

  (2)              In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

  (a)              games or other activities which require or encourage, or are designed to               require or encourage, individuals to-

  (i)               drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii)               drink as much alcohol as possible (whether within a time limit or otherwise);

  (b)               provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

  (c)               provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

  (d)               provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

  (i)               the outcome of a race, competition or other event or process, or

  (ii)              the likelihood of anything occurring or not occurring;

  (e)               selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

  2.              The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  3.              The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

   

  Conditions effective from 1st October 2010

   

  4.              (1)               The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

  (2)               The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

   

  5.              The responsible person shall ensure that-

  (a)               where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i)               beer or cider: ½ pint;

  (ii)               gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii)               still wine in a glass: 125 ml; and

  (b)              customers are made aware of the availability of these measures.

  
   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  Conditions carried over from Embedded Restrictions - Licensing Act 1964:

   

  Alcohol shall not be sold or supplied except during permitted hours. In this condition, permitted hours means that which are shown on the premises licence.

   

  As detailed in Schedule 1, Part 2, Paragraph 7 - music incidental to certain other activities

  The provision of entertainment consisting of the performance of live music or the playing of recorded music is not to be regarded as the provision of regulated entertainment for the purposes of this Act to the extent that it is incidental to some other activity which is not itself-

  (a)              A description of entertainment falling within Schedule 1, Part 1, Paragraph 2 or,

  (b)              The provision of entertainment facilities

   

  Therefore the premises is entitled to the 24-hour playing of background recorded music incidental to the sale of alcohol, but as an exemption within the Act, not a licensable activity.

   

   

  Conditions offered by applicant:

   

  Protection of Children from Harm Licensing Objective-

  Children will be required to vacate the bar by 21.00 hrs, unless they are eating when they will be required to vacate the bar by 21.30 hrs

  Children must be accompanied by a responsible adult at all times and required to maintain constant supervision over them

   

   

   

• ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

  Conditions agreed through mediation with Suffolk Constabulary at variation stage (December 2011)

   

  Fully auditable training records should be maintained for all staff in respect of the sale of alcohol. These will be made available for inspection upon request to the Police and all other responsible Authorities.

  A record of all refusals of either service or admission will be maintained at head office recording all incidences of refusing persons and reason for refusal. The record will made available for inspection and copying by the Police and other Officers of Responsible Authorities as soon as practical or indeed within 7 days, and all such records to be retained for at least 12 months.

  Digital CCTV shall be used in the premises.

  A member of staff will be available on the premises during all opening hours that is trained and able to download images from the CCTV system.

  CCTV images shall be kept for a minimum of 21 days and available to Police and the Licensing Authority upon request.

  The CCTV shall be maintained and in good working order unless otherwise agreed with the Police.  The CCTV shall be monitored during licensable activity and cover all areas used for licensable activity and a camera be situated to provide a full facial image of persons entering the premises.

   

  Annex 3 - Conditions attached after a hearing by the licensing authority

   

  Conditions attached via Notice of Determination:

   

  The application for variation is granted subject to the Operating Schedule proposed by the applicants, but with the following alterations, which take into account the Police’s relevant representations:-

   

  1.              The supply of late night refreshment to cease 30 minutes later than was proposed by the applicants each night of the week, in accordance with police recommendations.  We impose this condition because we feel that it is necessary to promote the licensing objectives of prevention of crime and disorder, and prevention of public nuisance, because it will assist in a “wind down” period before the premises close to the public.

   

  2.              All staff employed on the premises must be briefed as to their responsibilities with regard to the supply of alcohol on the premises, and a record maintained of all training and briefings.  We impose this condition because we feel that it is necessary to promote the licensing objective of the prevention of crime and disorder.

   

  3.              We do not allow the proposed variation that would allow the applicants to have later hours on 12 occasions per year without the need for a Temporary Event Notice.  We refuse this variation because it was withdrawn by the applicants, and because we believe that it is necessary to do so to promote the licensing objective of prevention of crime and disorder.

   

  4.              Consumption of alcohol is to cease 60 minutes after the end of the period allowed for the supply of alcohol.  We impose this condition because we believe that it is necessary to do so for the promotion of the licensing objective of prevention of crime and disorder.

   

   

  5.              To ensure that the premises is a member of the Leisure Link Radio Scheme, or other Scheme approved by the Police to provide a means of two way communication to report incidents between the premises and the local Police or CCTV monitoring centre.

   

   

   

  6.              The holder of the premises licence shall use his best endeavours to ensure that CCTV equipment is maintained in good working order, monitored during licensable activity and covers all areas used for licensable activity.  The holder of the premises licence shall also use his best endeavours to ensure that CCTV equipment is checked prior to the start of licensable activity and that at least 75% of it is in operation at all times.  The holder of the premises licence is to ensure that repairs to the system are done as soon as reasonably practicable.  All CCTV tapes are to be retained for a minimum period of 28 days.  We impose this condition because we feel that it is necessary to promote the crime and disorder licensing objective.

   

  7.              To ensure that, when requested by the Police to do so, drinks are only available for consumption from plastic or toughened glass.  We impose this condition because we feel that it is necessary to promote the licensing objectives of prevention of crime and disorder, and public safety.

   

  8.              To ensure a secure deposit box is kept on the premises for the retention of confiscated items and ensure that the Police are advised of any items which require safe disposal.  We impose this condition because we feel that it is necessary to promote the licensing objective of prevention of crime and disorder.

   

  9.              The Designated Premises Supervisor, or a person nominated by her, is to participate in the local Pubwatch / Nightsafe scheme operating in the Borough.

   

   

  Conditions attached following Magistrates Appeal Hearing:

   

  On any Friday or Saturday night when the premises remain open for the sale of alcohol after 11pm, a minimum of 2 SIA registered door supervisors to be present on the premises from 10 pm until the end of the period for consumption of alcohol on those nights unless otherwise agreed by the police. 

   

  If the premises are not going to open for the sale of alcohol beyond 11pm on a Friday or Saturday night, at least 7 clear days notice should be given to the police. If the DPS decides to close the premises on a Friday or Saturday night after 11pm but before the premises are required to close to the public he will ensure that the Police Control Room is notified as soon as the decision to close is taken.
