Annex 2 - Conditions consistent with the Premises Operating Schedule
Conditions carried over from Embedded Restrictions - Licensing Act 1964:
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means that which are shown on the premises licence.
Restrictions
The above restrictions do not prohibit:
consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
the sale of alcohol to a trader or club for the purposes of the trade or club;
the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
the taking of alcohol from the premises by a person residing there; or
the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
Credit Sales
Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied:
a) with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal;
b) for consumption by a person residing in the premises or his guest and paid for together with his accommodation;
c) to a canteen or mess.

Children in Bar (No Children’s Certificate)-
No person under fourteen shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:
a) He is the child of the holder of the premises licence.
b) He resides in the premises, but is not employed there.
c) He is in the bar solely for the purpose of passing to or from some part of the premises which is not a bar and to or from which there is no other convenient means of access or egress.
d) The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of the licence is ancillary.
In this condition “bar” includes any place exclusively or mainly used for the consumption of alcohol. But an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.

Conditions offered by applicant:
Prevention of Crime & Disorder Licensing Objective-
The exterior areas of the premises will be well illuminated
All interior trading areas will be visible to staff from behind the bar servery
A rota system will be in place for checking toilets regularly
The licensees and staff will monitor customer behaviour especially during busy periods
Drug prevention measures will be employed and signs displayed regarding this
Anti drink-driving posters will be displayed on site
Public Safety Licensing Objective-
The licensee reserves the right to move the Fire Appliances, AWP Machines, Cigarette Machines, or any other similar objects temporarily fixed in a location which may impact on the ability of individuals on the premises to use exits or escape routes without impediment.
A Health & Safety policy will be in place and adhered to
Quarterly Risk Assessments will be carried out
The premises will be equipped with emergency lighting, illuminated exit signs, and a fire detection system throughout the entire building
All fire fighting equipment will be serviced annually
A fire alarm test will be carried out weekly
All portable electrical appliances will be tested annually
There will be current electric and gas certificates in place
Mechanical extraction will be provided in each bar with an air cleaner in one bar
A pest control contract will be maintained
The premises has a first aider and first aid facilities
The premises will promote a licensed taxi service
An accident / incident book will be kept on site for staff and public use
Prevention of Public Nuisance Licensing Objective-
When required, staff will organise taxis for customers
Customers will be seen off the premises and encouraged to disperse at closing time
All standard glasses will eventually be replaced with toughened glasses
The cellar cooking condenser will be positioned in an area so as not to cause nuisance to neighbours or is sound proofed
Signs will be present stating “please respect our neighbours and leave quietly”
Protection of Children from Harm Licensing Objective-
The premises has a children’s menu and suitable soft drinks to promote a family atmosphere
Conditions offered by applicant at Minor Variation stage (May 2013)
Children will only be permitted when accompanied by an adult
Children will be permitted to remain on the premises until 9pm, unless they are taking a meal or attending a function, charity event or quiz night when they will be permitted to remain until the end of the meal, function, event or quiz
Annex 3 - Conditions attached after a hearing by the licensing authority
a. The outside seated area at the front of the premises shall not be used by customers after 2300 hours.
b. A notice shall be erected visible from the outside seated area at the front of the premises to inform customers about the effect of the previous condition. (a. outlined above)
