Annex 2 - Conditions consistent with the Premises Operating Schedule
Conditions offered by the applicant and variation stage (May 2009)
General - all four licensing objectives
1. The premises licence holder shall adhere JD Wetherspoon’s “Code of Conduct for Responsible Retailing” as amended from time to time. (The October 2007 version accompanied this application)
2. The premises licence holder will ensure that there are sufficient staffing levels including managers to encourage responsible behaviour on the premises at all times.
3. Non-alcoholic beverages including soft drinks, drinking water, coffee and tea shall be available at all times sale by retail of alcohol is carried out at the premises.
4. The premises will be constructed in accordance with the licence plan as is attached to the premises licence, or in the case of any alteration to that plan prior to opening any further drawing served on the licensing authority and responsible authorities prior to the re-opening of the premises.
The Prevention of Crime and Disorder/ Public Safety/ Prevention of Noise Nuisance
1. The premises licence holder will risk assess the need for door supervisors at the premises and/or employ such door supervisors at such time and in such numbers as deemed necessary by the risk assessment and/or at any other times upon agreement with the police.
2. The premises licence will ensure that there are sufficient staffing levels including managers to encourage responsible behaviour on the premises at all times.
3. The premises licence holder shall take reasonable steps to ensure the DPS or a nominated member of staff shall be a member of Pubwatch or a similar scheme where available who shall use his or her best endeavours to attend regular meetings of such a scheme.
4. CCTV shall be installed at the premises in compliance with any reasonable requirement of the police crime prevention officer and images will be retained for a minimum of 21 days and made available to the police on request. Members of the management team will be trained in the use of the system.
5. The premises licence holder will ensure that all staff at the premises have been trained in accordance with established J D Wetherspoon PLC training procedures. Specifically the premises licence holder will ensure that all employees are trained in their responsibilities to prevent alcohol being served to anybody who is under the legal age limit or to anyone who appears to be drunk or to anyone who is trying to purchase alcohol on their behalf.
The protection of children from harm
1. The premises licence holder will operate a “Challenge 21” policy at all times.
2. Suitable food and non-alcoholic beverages shall be available at all times children are allowed on the premises.
3. Non-alcoholic beverages including soft drinks, water, coffee and tea shall be available at all times, sale by retail of alcoholic is carried out at the premises.
Conditions attached after mediation with the Ipswich Police
Door Supervisors
1. Unless otherwise agreed in writing with the Suffolk Constabulary, on Fridays and Saturdays there should be a minimum of 4 SIA registered door supervisors, who may include SIA registered members of staff, up to 400 of customer capacity and 1 additional door supervisor per 100 of customer capacity thereafter, on duty from 20:00 hours until close.
2. Unless otherwise agreed in writing with the Suffolk Constabulary, on Thursdays there should be a minimum of 2 SIA registered door supervisors, who may include SIA registered members of staff, up to 200 of customer capacity and 1 additional door supervisor per 100 of customer capacity thereafter, on duty from 20:00 hours uncil close.
3. Door supervisors will wear their SIA badges in approved fluorescent armbands, displayed in a prominent position on their arm
The above agreement will be reviewed with the Police 3 months after opening; ie; 1st August 2009.
Log Books
4. A door supervisor log book will be maintained in which shall be recorded the date any incidents take place at the licensed premises, the name, address and telephone number of any person who is involved with the incident, where provided, including the calling of the police and any police action taken where applicable.
5. A record of the names and registration number of any door supervisors employed at the premises, the identity of their employer where not the premises licence holder, together with the start time and finish time of their employment will be maintained.
Communications
6. The premises will be a member of, and actively use, the Leisure Link Radio Scheme, or other scheme approved by Suffolk Police, to provide a means of two-way communication to report incidents between the premises and the local Police or CCTV monitoring centre.
Barwatch
7. The premises licence holder shall take reasonable steps to ensure the DPS or a nominated member of staff shall be a member of the local Barwatch or a similar scheme where available who shall use his or her best endeavours to attend regular meetings of such a scheme.
8. The premises licence holder will ensure that the premises is a member of Pubwatch Online or equivalent scheme when in operation.
CCTV
9. CCTV shall be installed at the premises in compliance with any reasonable requirement of the police crime prevention officer. The CCTV system must be well maintained and any defects should be rectified as soon as practicable. All CCTV recordings will be retained for a minimum of 21 days and made available to the police on request. Members of the management team will be trained in the use of the system.
Protection of Children From Harm
10. The premises licence holder will maintain a system for recording refusals and ensure that this is maintained record of the refusal will be made available to Police on request.
Conditions attached after mediation with Ipswich Borough Council Occupational Health and Safety Team
1. No laser beams (pyrotechnics or real flame), strobe lights, explosives, flammable or smoke producing agents, toxic or hazardous substances and any similar entertainment involving special effects or special risks shall be used on the premises except with the consent of the licensing authority.
2. The number of persons admitted to the premises on any one occasion shall not exceed any maximum permitted number stated in the licence (such number to be inclusive of staff at the premises) and overcrowding in any part of the premises so as to interfere with the safety or comfort of the public shall not be permitted.
3. The licensee shall employ a suitable method of determining the numbers of persons on the premises at any one time to ensure that any maximum permitted number is not exceeded.
Condition attached after mediation with Ipswich Borough Council Environmental Protection Team
1. Any noise generated by licensable activities carried out at the premises should be inaudible within the nearest residential premises.
