Annex 2 - Conditions consistent with the Premises Operating Schedule
Conditions offered by the applicant
General
1. All applicable regulations including Health & Safety, Fire Safety will be implemented, maintained and complied with
2. The manager will be the designated person responsible for public safety
3. Complete co-operation with Police, local authorities, community organisations and other relevant bodies for prevention and public nuisance
4. The manager shall ensure the public information notices about crime and disorder issues are displayed at the request of the Council or Suffolk Constabulary
The Prevention of Crime and Disorder
1. All staff will be trained in responsible alcohol service
2. All staff will maintain a responsible atmosphere with the customer
3. There will be a 30 minute ‘time up’ policy adhered to on serving alcohol
4. Manage aggressive and anti-social behaviours calmly and avoid escalations
5. The manager will ensure that the consumption of alcohol is restricted to the areas identified on the plan attached to the operating schedule
6. An incident book will be kept and maintained on the premises
7. Keep the sightline clear for vigilance
8. Video/CCTV equipment will be installed inside the premises and to ensure that it is maintained in working order and set to record
9. Recordings will be retained for at least twenty eight days and that copies in a viewable format are produced to an authorsied officer on demand
10. CCTV in operation notices will be displayed on the premises so that they are clearly visible to the public within the licensed premises
Public Safety
1. Health & Safety and Fire Regulation procedures will be implemented and maintained
2. A member of staff/manager will be designated as person responsible for public safety
3. Staff will be trained in Health & Safety procedures and a Health & Safety register will be maintained
4. Health & Safety equipment will be installed, maintained and complied with
5. Provision of emergency lighting equipment
6. Installation and maintenance of smoke detectors
7. Emergency escape routes to be kept cleared at all times and an evacuation procedure will be maintained and complied with
8. Fire marshals will be designated
9. It will be ensured that atleast one trained first aider will be on duty when the public is present
The Prevention of Public Nuisance
1. No sale of alcohol to over the limit customers policy will be implemented
2. It will be ensured that any person selling or supplying alcoholic drink under the authority of a personal licence holder asks for a photo ID proof of age where they have reason to suspect that the individual may be under 18 years of age
3. It will be ensured not to permit any irresponsible drinks promotions at the licensed premises that may negatively impact on the promotion of the licensing objectives
4. Complete co-operation with Police, local authorities and community organisations and other relevant bodies for prevention of public nuisance
5. Playing of recorded music will be kept at ambient level within internal areas
6. Doors and windows are kept closed (except for ingress and egress) to reduce noise
7. Music will be discernibly quieter during the final hour of opening
8. External lighting will be installed and maintained at the licensed premises in order to promote the licensing objectives and I will liaise with the appropriate Environmental Services department to ensure that any lighting is positioned and of such design so as to minimise the risk of causing public nuisance by light pollution
9. Adequate, separate and suitable (lidded) receptacles to receive and store refuse from the premises site
The Protection of Children from Harm
1. All alcoholic drinks will be kept in a separate fridge and out of reach of children
2. ‘No ID, No Alcohol’ sign will be put on fridge containing the alcoholic drinks
3. Child seats will be made available
CONDITIONS RELATING TO THE PREVENTION OF CRIME AND DISORDER
CCTV & Communication
1. I will install Video/CCTV equipment inside/outside the premises and ensure that it is maintained in working order.
2. I will set Video/CCTV equipment to record from the time that the premises open to the public until the premises close and all members of the public have left.
3. I will ensure that recordings are retained for at least twenty eight days and that copies in a viewable format are produced to an authorised officer on demand.
4. I will put up notices advising that CCTV has been installed on the premises so that they are clearly visible to the public within the licensed premises.
Bottles and Glasses
5. I will ensure that drinks are only available for consumption from plastic vessels or toughened glass.
6. I will ensure that no drinks are available for consumption from glass bottles
7. Where glass bottles are used, they will be retained or disposed of on the premises.
8. I shall ensure that customers are not permitted to take opened bottles or glasses out onto the public highway, during times, for example, when they are complying with the provisions of the smokefree regulations or making use of any pavement café permission held by the licensed premises.
Restrictions on Drinking Areas
9. I will ensure that the consumption of alcohol is restricted to the areas identified on the plan attached to the operating schedule.
Proof of Age Cards
10. I will ensure that any person selling or supplying alcoholic drink under the authority of a personal licence holder asks for a photo ID proof of age where they have reason to suspect that the individual may be under 18 years of age.
Drinks Promotions
11. I shall not permit any irresponsible drinks promotions at the licensed premises which may negatively impact on the promotion of the licensing objectives.
Notices
12. I shall ensure that public information notices about crime and disorder issues are displayed at the request of the Council or the Suffolk Constabulary. (e.g. Customer Code of Conduct)
Lighting
13. I will ensure that lighting is provided outside the premises (and in my private car park) during the hours of darkness when any licensable activity takes place on the premises.
CONDITIONS RELATING TO PUBLIC SAFETY
Access for Emergency Vehicles
14. Access for emergency vehicles is kept clear and free from obstruction
First Aid
15. I will make sure that adequate and appropriate supply of first aid equipment and materials is available on the premises
16. I will make sure that at least 1 trained first aider(s) will be on duty when the public are present
Temporary Electrical Installations
17. I will make sure that where temporary electrical wiring and distribution systems have not been installed by a competent person, they are inspected and certified by a competent person before they are put to use.
Public Liability Insurance
18. I will make sure that I have valid public liability insurance in force and that a copy of the schedule is available for inspection by an authorised officer on request.
General
19. I will make free drinking water available at all times the premises is open to the public;
CONDITIONS RELATING TO THE PREVENTION OF PUBLIC NUISANCE
Noise and vibration
20. I will make sure that Noise or vibration is not noticeable at the façade of any noise sensitive premises and/or residential properties including periodic monitoring;
21. I will make sure that doors and windows are kept closed (except for ingress and egress) to reduce noise nuisance from the premises;
22. I will make sure that during the final hour of opening the music is discernibly quieter;
Noxious smells
23. I will ensure that offensive smells from the licensed premises are not permitted so as to cause a nuisance to nearby properties and the premises are properly vented.
24. Ensure that receptacles for waste are emptied regularly to minimise nuisance smells.
Light pollution
25. External lighting shall be installed and maintained at the licensed premises in order to promote the licensing objectives and I shall liaise with the appropriate Environmental Services department to ensure that any lighting is positioned and of such design so as to minimise the risk of causing public nuisance by light pollution.
Litter
26.I will provide adequate and suitable (lidded) receptacles to receive and store refuse from the premises/site
27. I will make sure that receptacles for refuse storage are maintained in a clean condition.
28. I will make sure litter is regularly cleared from the vicinity of the premises
CONDITIONS RELATING TO THE PROTECTION OF CHILDREN FROM HARM
General
29. I will comply with Retailer Alert Bulletins issued by Portman Group Note: This condition may be appropriate for licensed premises selling alcohol products in a manner that may appeal to or attract minors.
30. I will implement a proof of age policy agreed by the police and local authority; Note: Proof of age cards are dealt with in the pool of conditions relating to the crime and disorder objective. However, it may be appropriate to consider the production of proof of age cards to ensure that appropriate checks can be made where the presence of children is restricted by age at certain time.
31. I will ensure an adequate risk assessment is in place with regard to the protection of children from harm whilst they may be present on the premises and while licensable activities are taking place. Such risk assessment to be produced to an authorised officer on demand.
