Annex 2 - Conditions consistent with the Premises Operating Schedule
Conditions carried over from Embedded Restrictions - Licensing Act 1964:
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means that which are shown on the premises licence.
Conditions offered by applicant:
Prevention of Crime & Disorder Licensing Objective-
The licensee will be an active member of the Local and National Pubwatch
The licensee will liase closely with the police when required
The licensee will follow the guidance offered by the Portman Group in relation to drinks promotions
The premises operates a customer loyalty scheme
Public Safety Licensing Objective-
The licensee will ensure that the Fire Alarm system and Fire Extinguishers are fully maintained
The licensee will ensure that the premises is fully insured, and that electrical & gas tests are carried out annually
The licensee will ensure that all staff are trained to high standards
The licensee will provide a no smoking room
The licensee will ensure that all tables are cleared at regular intervals
Prevention of Public Nuisance Licensing Objective-
The licensee will use sound monitoring equipment
The licensee will ensure that no persons leave the premises with glass or bottles
The licensee will request that all customers leave quietly
The licensee will ensure that all persons leaving the premises after 23.30 pm do so via the Dove Street entrance
Protection of Children from Harm Licensing Objective-
Children are only allowed on the premises if accompanied by their guardian or parent
Persons under the age of 16 years are allowed on the premises until 21.00 pm, unless under exceptional circumstances (such as a family party)
All staff employed at the premises are to be briefed and trained in the care of young persons
Annex 3 - Conditions attached after a hearing by the licensing authority
The application is granted in part:
1. The variation to permit live music is granted for the hours requested (8.30 pm to 11 pm Monday to Sunday plus an additional 3 hours on New Year’s Eve from 11pm to 2am), but only to the extent that it permits music to be performed indoors.
2. The variation to permit recorded music is granted for the hours requested (10.am to 4am Monday to Sunday), but only to the extent that it permits music to be played indoors.
3. The variation to permit the provision of facilities for dancing is permitted for the hours requested (8.30pm to 11pm Monday to Sunday with an additional 7 hours from 11pm to 6am on New Year’s Eve) but only to the extent that it permits the facilities for dancing to be provided indoors.
4. The variation to permit the provision of late night refreshment from 11pm to 4am is granted.
5. The variation to permit the supply of alcohol is granted for the hours requested (10am to 4am Monday to Sunday, with an additional period on New Year’s day from 4am to 10am), but subject to the conditions appearing hereafter.
6. The variation to permit the premises to remain open from 10am to 5am is permitted in part, but the premises must close by 4.30 or 30 minutes after the last sale of alcohol.
The committee imposed the following conditions:-
1. Operating Hours
(a) The follow arrangements shall apply to the closure of the premises to the general public:
* on Monday to Thursday nights no sales of alcohol to the general public shall take place after 12 Midnight with 30 minutes drinking up time;
* on Friday and Saturday nights no sales of alcohol to the general public shall take place after 0100 Hrs with 30 minutes drinking up time; and
* on Sundays no sales of alcohol to the general public shall take place after 2300 hrs with 30 minutes drinking up time.
* On New Year’s Day the premises are not required to close.
(b) The Licensee shall ensure that all members of the general public shall leave the premises before the expiry of the drinking up time referred to in (a)
(c) The front door to the premises shall be closed at 2300 hrs each day and access to the general public will not be permitted after this time.
(d) No customer shall be admitted to the premises after 2300hrs unless they form either (i) part of a pre booked group of actors musicians production or technical crew who have been involved in a public performance that evening; or (ii) a pre-booked group of shift workers who have finished their shift no earlier than 2200 hours that day. The Licensee shall not permit anyone to enter the premises under this paragraph except via the rear door to the premises.
(e) No alcohol shall be sold after the hours mentioned in (a) unless it is to a regular customer holding a loyalty card issued by the licensee or to a person present in the premises by virtue of (d) above.
The committee would expect you to keep a written record of all bookings undertaken under (d) above. The drinking up time of only 30 minutes is allowed for the same reason as before.
2. CCTV & Communications
(a) The holder of the premises shall use his best endeavours to ensure that CCTV equipment is maintained in good working order, monitored during licensable activity and covers all areas used for licensable activity.
(b) The holder of the premises licence shall also use his best endeavours to ensure that CCTV equipment is checked prior to the start of licensable activity and at least 75% of it is in operation at all times.
(c) The holder of the premises licence is to ensure that repairs to the system are done as soon as reasonably practicable.
(d) All CCTV tapes are to be retained for a minimum period of 28 days.
3 Bottles & Glasses
(a) To ensure that when requested by the police to do so, drinks are only available for consumption from plastic or toughened glass.
(b) No customers will be admitted, or permitted to leave when carrying open bottles or glasses.
4. Drinks Promotions
To adopt and comply with the British Beer and Pub Associations guidelines on Point of Sale Promotions.
5 Crime Prevention Schemes
To participate in the local Pubwatch/Nightsafe scheme operating in the Borough.
