  Where licence authorises the supply of alcohol

   

  1.              No supply of alcohol may be made under the premises licence-

  (a)               at a time when there is no designated premises supervisor in respect of the               premises licence, or

  (b)               at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.              Every supply of alcohol under the premises licence must be made or authorised by a               person who holds a personal licence.

   

  The Licensing Act 2003 (Mandatory Licensing Conditions) (Amendment) Order 2014

   

  3.                (1)  The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

  (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-

  (a) a holographic mark, or

  (b) an ultraviolet feature.

   

  Conditions as specified by order of the Secretary of State under S19A of the Licensing Act 2003

  Conditions effective from 28th May 2014

   

  (1)              A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

  (2)              In this condition:-

  (a)              “permitted price” is the price found by applying the formula P = D + (D x V), where-

  (i)              P is the permitted price,

  (ii)              D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  (iii)              V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

  (b)              “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

  (c)              “relevant person” means, in relation to premises in respect of which there is in force a premises licence-

  (i)              the holder of the premises licence,

  (ii)              the designated premises supervisor (if any) in respect of such a licence, or

  (iii)              the personal licence holder who makes or authorises a supply of alcohol under such a licence;

  (d)              “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

  (e)              “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.

  (3)              Where the permitted price would not be a whole number of pennies, the permitted price shall be taken to be the price rounded up to the nearest penny.

  (4)              1) Where the permitted price on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.

  2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

   

• Annex 2 - Conditions consistent with the Premises Operating Schedule

   

  Conditions offered by the applicant

   

  General

  1.              We will work closely with all Responsible Authorities to promote the responsible sale of alcohol within the Cumulative Impact area

  2.              CCTV monitoring and incident/refusal registers will be in operation and maintained together with a recognised age verification scheme

  3.              Regular training of staff will be carried out

   

  Public Safety

  1.              The premises will conform to all Health & Safety regulations

   

  The Prevention of Public Nuisance

  1.              All alcohol purchases will be consumed away from the premises

   

  The Protection of Children from Harm

  1.              Age verification scheme: ‘Challenge 25’ will be in place together with refusal book

   

  Conditions consistent with Operating Schedule

   

  1.              Ensure that CCTV at the premises is installed and maintained in an efficient working order

   

  2.              Any area of the premises to which the public have access (except toilets) must be covered by CCTV and shall operate at all times when the premises are open to the public

   

  3.              The quality and standard of recorded images will meet the requirements of the Police and Local Authority to enable positive identification of individuals

   

  4.              Recorded images shall be retained by the venue for a period of no less than 31 days

   

  5.              Recorded images shall be supplied to the Police, Fire Service and Licensing Authority upon reasonable request in a format so it can be played back on a standard personal computer or standard DVD player (eg. Memory stick/CD/DVD)

   

  6.              Authorised staff shall be trained in the operation and usage of the CCTV system including the viewing and downloading of images in order that they can be made available to the Police or an authorsied officer of a responsible authority upon reasonable request

   

  7.              No super-strength beer, lagers or ciders above 6.5% ABV (alcohol by volume) shall be sold at the premises

   

  8.              No single cans or bottles of beer or cider shall be sold at the premises

   

  9.              The Premises Licence Holder shall ensure that all staff at the premises are trained so that they are fully aware of the specific role and responsibilities of the designated premises supervisor, and the contact details for the designated premises supervisor when he or she is away from the premises

   

  10.              A refusals log/electronic till record shall be kept, detailing all refused sales of age restricted products including alcohol. The log should include the date and time of the refused sale and enable identification of the member of staff who refused the sale. The log shall be available for inspection upon request at the premises to which it relates, at any time by an officer authorized by one of the Responsible Authorities

   

  11.              Alcohol shall only be sold by a Personal Licence Holder, or by a person who has attained a nationally recognized, accredited qualification  such as the BIIAB Level 1 Award in Responsible Alcohol Retailing (ARAR) or the Trading Standards Institute Fair Trading Award (FTA) in underage sales. If other training courses or qualifications are used or held by staff the licensee must be able to demonstrate their suitability to the satisfaction of officers of the responsible authorities upon request

   

  12.              The Premises Licence Holder shall adopt ‘Challenge 25’ as its age verification policy, whereby any person who appears to be 25 years of age or under will be asked to produce acceptable identification to prove they are infact aged 18 years or over.

  Acceptable identification means: Valid photo card driving licences, passports, military identification or proof of age cards bearing the PASS hologram

   

  13.              The Premises Licence Holder will prominently display signage in the public areas of the premises, and at the point of sale, reminding customers and staff of the ‘Challenge 25’ policy in operation

   

  14.              The Premises Licence Holder shall ensure that signage relating to the date of birth on which an individual would have been born in order to have attained the age of 18 years, is displayed at the point of sale in a position clearly visible to staff members when selling alcohol. This may be removed if the same message can be relayed electronically on screen as a reminder to staff when alcohol (or other age restricted products) is scanned at the point of sale

   

  15.              No person under the age of 18 shall sell alcohol. This includes the prohibition of ‘supervised’ sales by persons under 18

   

  16.              The Premises Licence Holder shall ensure that all staff complete regular ‘Challenge 25’ training and sign to acknowledge their understanding of these responsibilities at least once every three months (quarter). Training records will be maintained and produced for inspection by the Police or Authorised Officers of the Licensing Authority

   

  Conditions attached at Minor Variation Stage (November 2016)

   

  1.              Mr Omer Mohammed Said, Mr Mustafa Hamadamin and Mrs Melissa Hamadamin shall not have any involvment in the business of the Premises Licence Holder whatsoever               and shall be excluded from the premises

   

  2.              No purchases shall be made of any alcohol or tobacco products from door to door sellers

   

  3.              Contact shall be made to the Police or the Local Authority immediately if any               approach is made by door to door sellers at the premsies attempting to sell               alcohol, cigarettes               and/or tobacco products

   

  4.              All receipts for good bought shall include the following details;

                                     sellers name and address

                                     sellers compant details, if applicable

                                      sellers VAT details, if applicable
