Annex 2 - Conditions consistent with the Premises Operating Schedule
CONDITIONS OFFERED BY THE APPLICANT
Door Supervisors
1. I will ensure that any Door Supervisors used are registered by the Security Industry Authority. (N.b. This is
a mandatory condition where Door Supervisors are employed or used on a licensed premises)
Restrictions on Drinking Areas
2. I will ensure that the consumption of alcohol is restricted to the areas identified on the plan attached to
the operating schedule.
Notices
3. I shall ensure that public information notices about crime and disorder issues are displayed at the request
of the Council or the Suffolk Constabulary, (e.g. Customer Code of Conduct)
4. I will display any restrictions on the admittance of individuals according to age (e.g. Children) on or
immediately outside the premises.
Lighting
5. I will ensure that lighting is provided outside the premises (and in my private car park) during the hours of
darkness when any licensable activity takes place on the premises.
Escape Routes
6. I will make sure that escape routes and exits, including external exits, are maintained to ensure that
they are not obstructed, in good order with non-slippery and even surfaces, free of trip hazards and
clearly identified.
7. I will make sure that where chairs and tables are provided, internal gangways are kept unobstructed.
8. I will make sure that all exit doors are easily openable and do not require the use of a key, card, code or
similar means
9. I will make sure that any removable security fastenings are removed whenever the premises are open to
the public or occupied by staff.
10. I will make sure that all fire doors are maintained effectively self-closing and not held open other than by
approved devices (for example, electromagnetic releases operated by smoke detectors).
11. I will make sure that fire resisting doors to ducts, service shafts, and cupboards are kept locked shut.
12. I will make sure that the edges of the treads of steps and stairways are maintained so as to be
conspicuous.
Curtains, Hangings, Decorations and Upholstery
13. I will make sure that any upholstered seating meets on a continuous basis the pass criteria for smouldering
ignition source 0, flaming ignition source 1 and crib ignition source 5 when tested in accordance with
section 5 of Bs 5852:1990.
Fire Action Notices
14. I will make sure that notices detailing the action to be taken in the event of fire or other emergencies,
including how the fire brigade should be summoned, are prominently displayed and protected from
damage and deterioration.
Outbreaks of Fire
15. The fire brigade will be called at once to any outbreak of fire, however slight, and the details recorded
in a Fire Log-book.
Disabled People
16. I will make sure that when disabled people are present, adequate arrangements exist to enable their safe
evacuation in the event of an emergency, and that patrons are made aware of these arrangements;
First Aid
17. I will make sure that adequate and appropriate supply of first aid equipment and materials is available
on the premises
18. I will make sure that at least (please specify …..) trained first aider(s) will be on duty when the public
are present
Lighting
19. In the absence of adequate daylight, I will make sure that the lighting in any area accessible to the public
is fully operational;
20. I will make sure that Fire safety signs are adequately illuminated;
21. I will not alter Emergency lighting without prior notification to the Licensing Authority
22. I will make sure that Emergency lighting batteries are fully charged before admission of the public;
Safety Certificates
23. I will make sure that the following systems are maintained and inspected by suitably qualified
professional persons in accordance with any British Standards and at intervals recommended in
national guidance, and will keep the records of such inspections available for inspection by
authorised officers on request:

Gas boiler, calorifier or appliance

Public Liability Insurance
24. I will make sure that I have valid public liability insurance in force and that a copy of the schedule is
available for inspection by an authorised officer on request.
Alterations to the premises
25. I will not alter the premises in such a way as to make it impossible to comply with an existing licence
condition, without first seeking a variation of the premises licence.
(N.B This will enable you to propose the amendment of any conditions that you would not be able to
comply with upon completion of works)
General
26. I will make free drinking water available at all times the premises is open to the public;
Balcony Fronts
27. I will make sure that clothing or other objects are not placed over balcony rails or upon balcony fronts.
CONDITIONS RELATING TO PUBLIC SAFETY (Late night refreshment)
28. I will make sure that where tables and chairs are provided, clear gangways to exits are maintained;
29. I will not use portable heating appliances on the premises;
30. I will not use any appliances utilising cylinders or containers of gas on the premises;
31. I will not use any paraffin or other mineral oil in any lamp, stove or other appliance except for
cooking purposes;
Noise and vibration
32. I will make sure that the placing of bottles into receptacles outside the premises takes place at times
that will minimise disturbance to nearby properties;
33. I will make sure that any request by an authorised officer of the Council in relation to reducing noise
levels is complied with.
34. I will ensure that any ventilation system has suitable sound attenuation.
Noxious smells
35. I will ensure that offensive smells from the licensed premises are not permitted so as to cause a nuisance
to nearby properties and the premises are properly vented.
36. Ensure that receptacles for waste are emptied regularly to minimise nuisance smells.
Light pollution
37. I will ensure that flashing or particularly bright lights on or outside the licensed premises do not cause a
nuisance to nearby properties, whilst balancing the need for lighting in the interests of prevention of crime
and disorder.
Litter
38. I will provide adequate and suitable (lidded) receptacles to receive and store refuse from the
premises/site
39. I will make sure that receptacles for refuse storage are maintained in a clean condition.
Access for children to licensed premises generally
40. I will require that children under the age of 12 are accompanied by adults after 11pm in the evening.
Variation of the premises licence 04 November 2019
Conditions agreed through mediation with Suffolk Constabulary
The premises shall install and maintain a comprehensive CCTV system as per the minimum requirements of the Police. All entry and exit points will be covered as will all areas where licensable activities are happening, enabling frontal identification of every person entering in any light condition. The CCTV system shall continually record whilst the premises is open for licensable activities and during all times when customers remain on the premises. All recordings shall be stored for a minimum period of 30 days with date and time stamping.
Recordings shall be made available within 24 hours upon the request of Police or authorised officer throughout the preceding 30 day period.
A staff member from the premises who is conversant with the operation of the CCTV system shall be on the premises at all times when the premises are open to the public. This staff member will be able to show a Police or Authorised Licensing Officer recent data or footage with the absolute minimum delay when requested and be able to download relevant footage onto a disc or memory stick.
A CCTV log must be maintained and endorsed by signature indicating that the system is checked weekly. In the event of any failings or faults, any actions taken to remedy the failings or faults are recorded. In the event of technical failure of the CCTV equipment, the premises licence holder or DPS will report the failure to the Police and Licensing Authority immediately.
A Challenge 25 policy must be implemented whereby all customers who appear to be under 25 must produce photographic identification in the form of a passport, driving licence or proof of age scheme (PASS) approved identification before alcohol can be supplied or sold to them. All staff will be instructed, through training, that alcohol cannot be supplied or sold unless this evidence is produced.
The premises licence holder shall ensure that notices shall be prominently displayed in the premises to advise patrons and staff that a ‘Challenge 25’ scheme operates in the premises.
An incident log will be maintained and be kept for a minimum of 12 months from the date of each entry and will be provided to the Police and all other Responsible Authorities on request.
A register of refusals will be maintained and this will need to be kept for a minimum of 12 months from the date of each entry and will be provided to the Police and all other Responsible Authorities on request.
All Staff engaged in the sale of alcohol to be trained in responsible alcohol retailing to the minimum standard of BIIAB level 1 or equivalent (which includes relevant in house training), within three months of commencing employment at the premises. all staff to be given refresher training every quarter.
Fully auditable training records should be maintained for all staff in respect of the sale of alcohol. These will be made available for inspection upon request to the Police and all other Responsible Authorities.
Sales of alcohol are not to include any super strength lagers, beers or ciders where strength exceeds 6.5% ABV (alcohol by volume) or above. This restriction shall not apply in respect of specialist branded, premium priced products - such as craft ales, local or micro-brewery specialist products, boxed gifts or national celebratory or commemorative beer, lager or cider.
Where the off sale of alcohol is through the internet or mail order the premises licence holder will ensure that for deliveries of alcohol they will still operate the challenge 25 policy whereby customers who do not look over 25 will be asked to provide proof of age to show that they are aged 18 or over at the point of delivery. By placing an order that includes alcohol the customer confirms they are over 18 years old. The premises licence holder will ensure that a courier service is used for deliveries of alcohol and that they use the challenge 25 policy and record what ID they checked.
