Annex 1 - Mandatory Conditions
Where licence authorises the supply of alcohol
1. No supply of alcohol may be made under the premises licence-
(a) at a time when there is no designated premises supervisor in respect of the premises
licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
2. Every supply of alcohol under the premises licence must be made or authorised by a person
who holds a personal licence.
Conditions as specified by order of the Secretary of State under S19A of the Licensing Act 2003
Conditions effective from 1st October 2010
1.
(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
CONDITIONS OFFERED BY THE APPLICANT
GENERAL
We will work closely with Responsible Authorities to prevent crime, disorder & nuisance. All stock will be secured against theft. Customers will not consume alcohol or congregate near to the premises. Staff will have ongoing training & development.
THE PREVENTION OF CRIME & DISORDER
CCTV will be installed and operate to required standards. The building will have CCTV and has additional security shuttering to all windows and main entrance. Drunk persons will not be supplied alcohol. Refusals book will be maintained
PUBLIC SAFETY
The premises will conform to all statutory requirements. Fire system installed and regularly maintained.
THE PREVENTION OF PUBLIC NUISANCE
Drunk persons will be refused service of alcohol. Customers will not be allowed to consume alcohol purchased in or near to the premises.
THE PROTECTION OF CHILDREN FROM HARM
Age verification system will be in operation - Challenge 21 - refusals book will be maintained.
Conditions Attached Following Mediation with the Ipswich Police
The Prevention of Crime and Disorder
Fully auditable training records should be maintained for all staff in respect of the sale of alcohol. These will be made available for inspection upon request to the Police and all other Responsible Authorities.
CCTV shall be installed at the premises in compliance with recommendations from an appropriately qualified security company.
The holder of the premises licence shall ensure that the CCTV equipment is maintained in good working order, monitored during licensable activity and covers all areas used for licensable activity and that CCTV equipment is checked prior to the start of the licensable activity. An auditable record must be maintained. The holder of the premises licence is to ensure that repairs to the system are carried out expeditiously.
CCTV recordings to be retained for a minimum of 21 days and will be made available to the Police or authorised officer upon request, or at the earliest opportunity agreed at the time of request.
All staff should be trained in the use of the CCTV system and be able to provide copies when requested.
Protection of Children from Harm
No Super strength lagers, beers or Ciders - (6.5% alcohol by volume or above) are to be sold from the premises, (either cans or bottles).
Conditions attached following a Hearing of the Licensing Sub-Committee on 30th March 2011
The Sub-Committee grant a licence in the following terms and have taken into account the police and the interested party’s relevant representations:-
1. The premises may open to the public for the purpose of the provision of alcohol for consumption off the premises during the following hours;
Monday to Sunday from 08:00 until 23:00.
2. The supply of alcohol to be during the following hours;
Monday to Sunday from 08:00 to 23:00.
The Sub-Committee impose the following conditions;
a) That Video/CCTV equipment be installed at the premises (in compliance with recommendations from an appropriately qualified security company) and maintained in good working order. The holder of the premises licence shall ensure that the CCTV equipment is maintained in good working order, monitored during licensable activity and is to cover all areas both inside and outside the premises in the control of the licence holder and that the CCTV equipment is checked prior to the start of licensable activities each day the premises are open and that the equipment be set to record from the time the premises open to the public until the premises close and all members of the public have left. An auditable record is to be maintained by the licence holder. The licence holder is to ensure that any repairs required to be made to the CCTV equipment are carried out expeditiously. CCTV recordings are to be retained for a minimum period of 21 days and are to be made available to the police or any other authorised officer upon request, or at the earliest opportunity agreed at the time of a request being made. All staff at the premises are to be trained in the use of the CCTV system and be able to provide a copy/copies as and when requested. This condition was originally agreed between the applicant and the police and was subsequently amended by the Sub-Committee following today’s hearing. We impose this condition because we feel that it is necessary to promote the licensing objectives of the prevention of crime and disorder, public safety and the prevention of public nuisance.
b) That fully auditable training records are to be maintained for all staff in respect of the sale of alcohol. Any such records are to be made available for inspection upon the request of the police or any other authorised officer upon request. This condition was agreed between the applicant and the police ahead of today’s hearing.
c) No super strength lagers, beers or ciders i.e. those with an alcohol content by volume of 6.5% or above are to be supplied from the premises either in cans or bottles. This condition was agreed between the applicant and the police ahead of today’s hearing.
d) That there shall be a minimum of two staff on duty at the premises whenever the premises are open between the hours of 21:00 and 23:00 (earlier in the evening would be advisable/good practice whenever open for the supply of alcohol - however this is not a condition of the licence). We impose this condition because we feel that it is necessary to promote the licensing objectives of the prevention of crime and disorder, public safety and the prevention of public nuisance.
e) To ensure that any person selling or supplying alcoholic drink under the authority of a personal licence holder follows the guidelines of the Suffolk Constabulary Challenge 25 scheme and asks for photo ID proof of age where they have reason to suspect that the individual may be under 25 years of age and to ensure that signs relevant to this condition are prominently displayed at the premises. (This is imposed to replace the Challenge 21 scheme which the applicant had offered in his application). We impose this condition because we feel that it is necessary to promote the licensing objective of prevention of crime and disorder.
