Annex 2 - Conditions consistent with the Premises Operating Schedule
Conditions carried over from Embedded Restrictions - Licensing Act 1964:
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means that which are shown on the premises licence.
Restrictions
The above restrictions do not prohibit:
consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
the sale of alcohol to a trader or club for the purposes of the trade or club;
the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
the taking of alcohol from the premises by a person residing there; or
the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
Conditions carried over from Embedded Restrictions - Supper Hours Certificate:
Where a supper hours certificate is in place under s. 68, add (depending on whether one or both of the extensions in square brackets have been granted):
“Alcohol may be sold or supplied [on Christmas day, between 3 p.m. and 7 p.m.] to persons taking table meals in the premises in a part of the premises usually set apart for the service of such persons and for consumption by such a person in that part of the premises as an ancillary to his meal. For other purposes or in other parts of the premises the permitted hours shall continue to apply.”

Conditions carried over from Justices’ Licence:
Licence only extends to ground floor
Substantial refreshment to be available throughout licensed hours
Conditions offered by applicant:
Prevention of Crime & Disorder Licensing Objective-
A zero tolerance policy towards illegal drugs will be enforced at all times
If a disc jockey is used on any night then he/she will ask customers to leave quietly
A CCTV system will be maintained and notices will be displayed regarding this
All instances of Crime & Disorder will be reported to the police and will be kept in a incident log book
Public Safety Licensing Objective-
The applicants will ensure that the management and staff are fully briefed and trained on the company’s Health & Safety policy
Free drinking water will be made available at all times
Prevention of Public Nuisance Licensing Objective-
Notices will be displayed asking our customers to respect our neighbours when leaving the premises
If the premises decides to use the option to stay open for an extended period, then soft drinks and non alcoholic refreshment will be available between the cessation of the supply of alcohol and the closure of the premises
Protection of Children from Harm Licensing Objective-
When children are allowed on the premises, any entertainment offered within the premises will be suitable for young persons
A no smoking area will be provided
Soft drinks and non-alcoholic drinks will be made available
A recognised Proof of Age policy will be enforced.
Conditions offered through mediation with the Police:
Recorded music to be made discernibly quieter no later than 30 minutes prior to the end of hours during which premises is open to the public.
Late night refreshment to be available every day from midday until closing time.
Supply of alcohol to cease no later than 30 minutes before the premises is closed to the public for licensable activity on any day .
All staff employed on the premises must be briefed as to their responsibilities with regard to the supply of alcohol on the premises, and a record maintained of all training and briefings.
The premises should be a member of the Leisure Link Radio Scheme, or other police approved scheme to provide a means of two way communication to report incidents between the premises and the local Police or CCTV monitoring centre.
The holder of the premises licence shall use their best endeavours to ensure that CCTV equipment is maintained in good working order, monitored during licensable activity and covers all areas used for licensable activity. The holder of the premises licence shall also use their best endeavours to ensure that CCTV equipment is checked prior to the start of licensable activity and that at least 75% of it is in operation at all times. The holder of the premises licence is to ensure that repairs to the system are done as soon as reasonably practicable.
To ensure that any person selling or supplying alcoholic drink under the authority of a personal licence holder follows the guidelines of the Suffolk Constabulary Challenge 21 Scheme.
Conditions agreed through mediation with Suffolk Constabulary at variation stage (August 2011)
CCTV shall be provided in the form of a recordable system, capable of providing picture of evidential quality in all lighting conditions particularly facial recognition. Cameras shall cover the entrance and exit to the premises and also the holding bar area. Equipment must be maintained in good working order, the correct time and date stamped, recordings must be kept in date order, numbered sequentially and kept for a period of 28 days and made available to Police on demand. The Premises Licence Holder must ensure at all times a DPS or appointed member of staff is capable and competent at downloading CCTV footage in a viewable format on disk or storage device to the Police / Local Authority within 36 hours of a request. The recording equipment and disks shall be kept in a secure environment under the control of the DPS or other responsible named individual. An operational daily log report must be maintained and endorsed by signature, indicating the system has been checked and is compliant, in the event of any failings; actions taken are to be recorded. In the event of technical failure of the CCTV equipment, the Premises Licence Holder / DPS shall report the failure to the Police and Licensing Authority immediately.
