Annex 2 - Conditions consistent with the Operating Schedule
Schedule
1. In order to avoid unreasonable disturbance to residents of the neighbourhood in which the premises are situated, the premises shall not be opened or kept open for public refreshment, resort or entertainment at any time between 0300 and 0500 hours.
2. In order to ensure that persons frequenting the premises are not misled as to the nature or cost of the entertainment provided therein, Sections 8(1) and 8(2) of the Late Night Refreshment Houses Act 1969 shall apply to the grant (renewal) of this licence, the effect of which is as follows:
(i) It shall not be lawful to make any charge for or in connection with the entertainment of persons the premises during the hours of late opening (i.e. at any time when the premises are open between 0300 and 0500 hours), whether for the supply of food or drink, for admission, for service of any description or for any other matter, except any reasonable charge for the use of cloakroom or toilet facilities, unless -
(a) a tariff of charges made in the premises is kept displayed in such position and in such
manner that it can conveniently be read by persons frequenting the premises and can be so read by any such person before entering the premises, and
(b) the charge is specified for the matter in question in the tariff or is less than a charge so specified.
(ii) It shall not be lawful to seek to obtain custom for the premises by means of personal
solicitation outside or in the vicinity of the premises.
Conditions offered by applicant
General
The premises will operate as a restaurant selling food and non-alcoholic drinks for consumption on and off the premises
McDonald’s Restaurants Ltd will manage the premises in accordance with good management principles to secure as far as possible the promotion of the four licensing objectives
The Prevention of Crime & Disorder
McDonald’s Restaurants Ltd will maintain a CCTV system in operation on the premises while open to the public.
Immediate access to the CCTV system will be provided to Police Officers and Council Officers at their request
Public Safety
McDonald’s Restaurants Ltd will comply, as far as reasonably practicable, with relevant Health and Safety and Fire Safety legislation
All required Health and Safety Risk Assessments and Fire Safety Risk Assessments will be undertaken in writing and reviewed on a regular basis
The Prevention of Public Nuisance
McDonald’s Restaurants Ltd will ensure that the footpath immediately outside the front of the restaurant is kept clear of litter emanating from the premises
The Protection of Children from Harm
Children’s parties will not be held during the licensed period
