Annex 2 - Conditions consistent with the Operating Schedule
Conditions offered by the Applicant and mediated with Responsible Authorities
1. The Premises Licence Holder / DPS will make sure that noise or vibration is not noticeable at the façade of any noise sensitive premises and/or residential properties including periodic monitoring.
2. The Premises Licence Holder / DPS will make sure that doors and windows are kept closed (except for ingress and egress) to reduce noise nuisance from the premises.
3. The Premises Licence Holder / DPS will display prominent, clear and legible notices at all exits requesting patrons to respect the needs of local residents and to leave the premises and the area quietly.
4. The Premises Licence Holder / DPS will make sure that the placing of bottles into receptacles outside the premises takes place at times that will minimise disturbance to nearby properties.
5. The Premises Licence Holder / DPS will make sure that any request by an authorised officer of the Council in relation to reducing noise levels is complied with.
6. The Premises Licence Holder / DPS will ensure that any ventilation system has suitable sound attenuation.
7. The Premises Licence Holder / DPS will ensure that offensive smells from the licensed premises are not permitted so as to cause a nuisance to nearby premises and the premises are properly vented.
8. The Premises Licence Holder / DPS will ensure that receptacles for waste are empted regularly to minimise nuisance smells.
9. The Premises Licence Holder / DPS will ensure the music volume in the ground floor area will be lowered after midnight to such a level so as to be not noticeable at the façade of 6 Falcon Street when the premises doors are open.

11. The Premises Licence Holder / DPS shall give prior notice to the Licensing and Fire Authority when the venue intends to use any of the following special effects:
Foam cannons and snow machines,
Pyrotechnics, including fireworks,
Real flame,
Firearms,
Motor vehicles,
Strobe Lighting,
Explosives and highly flammable substances,
Lasers (see HSE Guide The Radiation Safety of Lasers for display purposes [HS (G) 95] and BS EN 60825; Safety of laser products).
12. At all times when operating for licensable activities effective control must be exercised over occupancy levels in all areas of the premises so as to avoid overcrowding to an extent prejudicial to health and safety.
13. All power supplies to instruments, audio equipment and any other equipment which is liable to be handled by staff or members of the public must be protected by residual current devices of a type suitable for personal protection.
14. The Premises Licence Holder / DPS shall ensure that a valid public liability insurance policy is in force at the premises and that a copy of the schedule is available for inspection by an authorised officer upon request.
15. The Premises Licence Holder / DPS shall ensure that clothing or other objects are not placed over balcony rails or upon balcony fronts.
16. CCTV shall be provided in the form of a recordable system, capable of providing pictures of evidential quality in all lighting conditions particularly facial recognition. Cameras shall encompass all ingress and egress to the premises, fire exits, outside areas and all areas where the sale/supply of alcohol occurs. Equipment must be maintained in good working order, be correctly time and date stamped, recordings must be kept in date order, numbered sequentially and kept for a period of 28 days and made available to Police on demand. The Premises Licence Holder must ensure at all times a DPS or appointed member of staff is capable and competent at downloading CCTV footage in a viewable format on disc or storage device to the Police/Local Authority within 36 hours of a request. The Recording equipment and discs shall be kept in a secure environment under the control of the DPS or other responsible named individual. An operational daily log report must be maintained endorsed by signature, indicating the system has been checked and is compliant, in the event of any failings; actions taken are to be recorded. In the event of technical failure of the CCTV equipment the Premises Licence Holder/DPS shall report the failure to the Police and Licensing Authority immediately.
17. Glass drinking vessels can be used on the ground floor in the Cocktail and Champagne bar and the Mezzanine on the top floor. Customers will not be allowed to enter other floors within the premises with drinks in glass bottles or glass drinking vessels, and this will be policed by door staff stationed on each staircase. Polycarbonate/plastic drinking vessels and bottles shall be used at all times on the second floor bar and dance area, in the event that the suppliers cannot provide polycarbonate/plastic bottles, then all glass bottled drinks will be decanted/dispensed and served in polycarbonate/plastic drinking vessels. All glass bottles accumulated behind the bar(s) shall be disposed of on the premises.
18. All bar staff engaged in the sale of alcohol to be trained in Responsible alcohol retailing to the minimum standard of BIIAB level 1 or equivalent, within three months of commencing employment at the premises. Training records shall be kept on the premises and produced to the Police and authorised Local Authority Licensing Officers on demand. For the avoidance of doubt this training can be administered in-house in accordance with the relevant criteria. Training will be reviewed six monthly to ensure staff are up to date with the latest legislation.
19. On Friday and Saturdays door supervisors are employed at the premises, at least one of them will be female. Two door staff will remain outside for 30 minutes after closing to assist with dispersal. On Fridays, there will be a minimum of 4 SIA registered door supervisors employed at the premises, of which a minimum of 3 will be on duty when the premises is open and a further 1 at 23.00, door supervisors employed at the premises, of which a minimum of 3 will be on duty when the premises open, a further 2 at 23.00 and 1 more at midnight. On every other day there will be a minimum of 2 door supervisors on duty when the premises are open up to 199 customers. For every 100 customers above this number the premises shall employ another door supervisors (one extra for each 100 customers), door supervisors will not start until 21.00 in the ground floor Cocktail and Champagne bar only.
The deployment of the door supervisors will be at the discretion of the premises management, however a visual presence will be maintained on all floors open to the public at all times licensable activities are taking place, in line with the details above. All door supervisors will be easily identifiable at all times by use of high visibility clothing/uniform. At all times when door supervision is required, a door supervisor shall monitor and manage the entrance and exit from the club to the smoking area. All door supervisors on commencing duty will sign an attendance book with their SIA number and signature.
20. The premises will employ an internal radio system allowing two-way communication between all members of relevant staff. In addition, the premises will subscribe to the Townlink radio system.
21. A search policy shall be implemented. A minimum ratio of one in ten customers will be randomly searched upon entry to the licensed premises. ALL persons suspected of possessing prohibited articles will be searched upon entry. Clear signage will be prominently displayed advising customers that they may be searched as a condition of entry. A table will be made available in the foyer area to conduct searches of larger items such as bags. Female customers will only be personally searched by a female member of door staff. A box will be made available where any prohibited articles are securely deposited prior to be taken to the safe in the office. Police will be notified within 36 hours of any prohibited articles for collection.
22. To enhance the mandatory condition relating to an age verification policy, the premises licence holder will implement the ‘Challenge 25’ scheme, ensuring prominent signage is displayed throughout the premises and all staff are trained in its operation.
23. An ejection policy will be implemented. That by use of either town link radio, the 999 service or other non-emergency number, all instances of ejection of persons from the premises must be notified to the Police at the time of happening or as soon as possible thereafter. Where an offence of violence has been committed the door supervisors will retain the offender, when it is safe to do so, for hand over to the Police or will take all reasonable steps to identify the offender and pass the identity to the Police as soon as is reasonably practicable. An incident book entry will be made on all occasions; times, dated and signed by a member of staff.
24. An incident book(s) / refusals register shall be kept and maintained on the premises at all times. The book(s) shall detail all incidents of injury/ejection/refusals/drug misuse/seizure/age challenge. Such matters shall be timed, dated and signed by the author and produced to Police/Authorised Licensing Officers on demand. In the case of refusals register, there shall be one at each bar area, or any other area utilised for the supply of alcohol.
25. The toilet areas will be checked whilst the premises are open for licensable activities. On a Friday and Saturday the toilet areas will be checked at least every hour the premises are open for licensable activities. A ‘Toilet-check’ log sheet will be endorsed to this effect and made available to Police and Local Authority Licensing Officers on demand. A member of staff will be employed in the male toilets to maintain order and ensure drug-taking practices are disrupted; this member of staff will have access to an internal radio capable of communicating with other members of staff. If this member of staff is unavailable, the Premises Licence Holder or DPS will notify the Police.
26. The premises License Holder/DPS will ensure there shall be no admittance or re-admittance after 2.15am.
Customers in the queue will be informed prior to 2.15am that they may not be successful in being admitted..
Customers will be permitted to continue to use the outside smoking area to the front of the building after 2.15am which will be controlled by smoking tickets and capped at a maximum of 15 people at any one time. The maximum number does not apply to the alleyway to the side of the building if this is used for a smoking area.
Customers, in exceptional circumstance will be allowed re-entry after 2.15 am on the provision that they are subject to re-searching and an incident report entry is made as to the reasons for leaving and re-entry.
27. Policies and logs will be written for the premises relating to the following categories:

These policies and logs will be up-to-date, accurate, relevant and subject to annual review.
28. Signage, in not less than 32 font, shall be clearly displayed prominently at the point of access, toilet areas and exits; appropriately, in relation to Age policy, Drug policy, Search policy, CCTV policy and Dispersal policy. A list of local taxi firm numbers will also be displayed at point of exit/entrance.
29. No person under the age of 18 shall be permitted on the licensed premises at any time whilst it is being used exclusively or primarily for the sale or supply of alcohol. Persons under the age of 18 will be permitted on the premises when the premises are being privately hired for a special event but each person under 18 must be accompanied at all times by at least 1 responsible adult. 1 adult cannot be the responsible adult for more than 4 children. Special events will be risk assessed on an individual basis and must comply with the premises Special Events policy.
30. All individuals, without any exception, subject to a local PubWatch ban will be refused entry and excluded from the premises for the entire duration of their ban. All staff will be alerted to the banned persons by the Pub Watch representative and report any attempt that such persons make to gain access to the premises to the Police.
31. It shall be the DPS’s responsibility to ensure that all staff are clearly instructed to not allow any drinking vessels to be removed from the premises by customers. For the avoidance of doubt, no drinking vessels should be taken into the smoking area. Empty drinking vessels shall be regularly collected so as to ensure no accumulation in areas where the public have access.
32. All instances of drunkenness, disorder, drug use or violence will be challenged, resulting in the ejection or retention of the individual(s) and under serious circumstances, consideration shall be given to their permanent exclusion from the premises in future.
33. Consumption of alcohol shall be restricted to the licensable area granted on the premises licence. For the avoidance of doubt, no alcohol is to be taken outside by customers using the smoking area.
34. The volume control of any amplification equipment being used on the licensed premises shall be under the direct control of the DPS/Manager, or another responsible individual nominated by the DPS, on all occasions. At the direct, justified request of an authorised officer of the Local Authority or Police, the volume level shall be decreased.
35. Any waste or litter, including smoking related litter, at the perimeter of the licensed premises shall be cleared once every 24hrs at the close of business. Adequate smoking related litterbins shall be provided at the front entrance and smoking areas of the premises and these shall be emptied on a daily basis.
36. The capacity in the premises shall be recorded by ticket/admission sale records, clicker, or other such counting device, the results of which shall be made available to an Authorised Officer of the Licensing Authority or Police on request and should be retained for a minimum of 60 days.
37. Complete First Aid kits must be located in the premises and be readily available to all staff at all times. The kits will be inspected weekly and replenished in the event of an item being used as soon as practicable. An endorsed log sheet will be contained in each kit. An accredited First Aid trained person shall be on duty at all times when the premises operate for licensable activities.
