• Annex 1 - Mandatory Conditions

   

  Where licence authorises the supply of alcohol

   

  1.                            No supply of alcohol may be made under the premises licence-

  (a)               at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)               at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.                            Every supply of alcohol under the premises licence must be made or authorised               by a person

               who holds a personal licence.

   

  Door Supervision

   

  Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority.

   

  Where the licence authorises the exhibition of Films

   

  1.              The admission of children to the exhibition of any film must be restricted in accordance with this section.

   

  2.              Where the film classification body is specified in the licence, unless subsection (3) (b) applies, admission of children must be restricted in accordance with any recommendation made by that body.

   

  3.              Where-               (a)               the film classification body is not specified in the licence, or

  (b)               the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  4.              In this section-              "children" means persons aged under 18; and "film classification              body" means the person or persons designated as the authority  under section 4 of the Video Recordings Act 1984 (c.39)  (authority to determine suitability of video works for classification).

   

   

  Conditions as specified by order of the Secretary of State under S19A of the Licensing Act 2003

   

  Conditions effective from 6th April 2010

   

  1.              (1)               The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

  (2)              In this paragraph, an irresponsible promotion means any one or more of the               following activities, or substantially similar activities, carried on for the purpose of               encouraging the sale or supply of alcohol for consumption on the premises in a manner

            which carries a significant risk of leading or contributing to crime and disorder, prejudice to

             public safety, public nuisance, or harm to children-

  (a)              games or other activities which require or encourage, or are designed to               require or encourage, individuals to-

  (i)               drink a quantity of alcohol within a time limit (other than to drink               alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii)               drink as much alcohol as possible (whether within a time limit or               otherwise);

  (b)               provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular               characteristic (other than any promotion or discount available to an               individual in respect of alcohol for consumption at a table meal, as               defined in section 159 of the Act);

  (c)               provision of free or discounted alcohol or any other thing as a prize to               encourage or reward the purchase and consumption of alcohol over a               period

  of 24 hours or less;

   

   

  (d)               provision of free or discounted alcohol in relation to the viewing on the               premises of a sporting event, where that provision is dependent on-

  (i)               the outcome of a race, competition or other event or process, or

  (ii)              the likelihood of anything occurring or not occurring;

  (e)               selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or               to refer to the effects of drunkenness in any favourable manner.

   

  2.              The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  3.              The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

   

  Conditions effective from 1st October 2010

   

  4.              (1)               The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

  (2)               The policy must require individuals who appear to the responsible person to be               under 18 years of age (or such older age as may be specified in the policy) to               produce on request, before being served alcohol, identification bearing their               photograph, date of birth and a holographic mark.

   

  5.              The responsible person shall ensure that-

  (a)               where any of the following alcoholic drinks is sold or supplied for               consumption on the premises (other than alcoholic drinks sold or               supplied having been made up in advance ready for sale or supply in a               securely closed container) it is available to customers in the following measures-

  (i)               beer or cider: ½ pint;

  (ii)               gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii)               still wine in a glass: 125 ml; and

  (b)              customers are made aware of the availability of these measures.

  CONDITIONS RELATING TO THE PREVENTION OF CRIME AND DISORDER

   

  Bottles and Glasses

  1.               Where glass bottles are used, they will be retained or disposed of on the premises.             

  2.               I shall ensure that customers are not permitted to take opened bottles or glasses out onto the public highway, during times, for example, when they are complying with the provisions of the smokefree regulations or making use of any pavement café permission held by the licensed premises.             

   

  Restrictions on Drinking Areas

  3. I will ensure that the consumption of alcohol is restricted to the areas identified on the plan attached to the operating schedule.                            

   

  Proof of Age Cards

  4.               I will ensure that any person selling or supplying alcoholic drink under the authority of a personal licence holder asks for a photo ID proof of age where they have reason to suspect that the individual may be under 18 years of age.                           

   

  Drinks Promotions

  5.              I shall not permit any irresponsible drinks promotions at the licensed premises which may negatively impact on the promotion of the licensing objectives.                           

   

  CONDITIONS RELATING TO PUBLIC SAFETY

   

  Access for Emergency Vehicles

  6.              Access for emergency vehicles is kept clear and free from obstruction              

   

  First Aid

  7.              I will make sure that adequate and appropriate supply of first aid equipment and materials is available on the premises             

  8.              If more than one first aider is present, I will make sure that their respective duties are clearly defined             

   

  Public Liability Insurance

  9.               I will make sure that I have valid public liability insurance in force and that a copy of the schedule is available for inspection by an authorised officer on request.             

   

  General

  10.              I will make free drinking water available at all times the premises is open to the public;             

  11.              I will provide a  “hot line” to a local taxi firm              

   

  THEATRES, CINEMAS, CONCERT HALLS & SIMILAR PLACES

  Premises used for closely seated audiences

  Attendants

  12.              The number of attendants on each floor in a closely seated auditorium will be as set out below:

  13.              I will make sure that attendants are not engaged in any duties that would hinder the prompt discharge of their duties in the event of an emergency or entail their absence from the auditorium where they are on duty;             

  14.              I will make sure that attendants will be readily identifiable to the audience;             

  15.              I will not use the premises for a closely seated audience except in accordance with seating plans.  A copy of the plan will be displayed at the premises;             

  16.              I will make sure that no article are attached to the back of any seats  which reduce the clear width of seatways or cause a tripping hazard or obstruction;             

   

  PREMISES USED FOR FILM EXHIBITIONS

  Attendants - premises without a staff alerting system

  17.              The following number of attendants will be present during film exhibitions (as set out in the tables below):

  18.              I will make sure that the following number of attendants are present during film exhibitions (as set out in the tables below):

  19.              I will make sure that the staff alerting system is maintained in working order;             

  20.              I will not consider the following persons available to assist in the event of an emergency: (i)  the holder of the premises licence or manager of the premises; (ii) a member of staff whose normal duties are likely to affect or delay his response in an emergency situation; (iii) a member of staff whose usual location when on duty is more than 60 metres from the location he would be required to go to on being alerted to an emergency situation;             

   

  Flammable films

  21.              I will make sure that no flammable films are allowed on the premises without prior notification to the fire and/or licensing authority;                           

   

  CONDITIONS RELATING TO THE PREVENTION OF PUBLIC NUISANCE

   

  Noise and vibration

  22.              I will not permit the playing of live or recorded music in garden areas of the premises after 20.30                           

  23.              I will make sure that any request by an authorised officer of the Council in relation to reducing noise levels is complied with.             

   

  Litter

  24.              I will provide adequate and suitable (lidded) receptacles to receive and store refuse from the premises/site                           

  25.              I will make sure that receptacles for refuse storage are maintained in a clean condition.             

  26.              I will make sure litter is regularly cleared from the vicinity of the premises              

   

  CONDITIONS RELATING TO THE PROTECTION OF CHILDREN FROM HARM

  Cinemas

  27.              I will not exhibit any film unless - It has received a "U", "PG", "12A", "15" or "18" certificate from the British Board of Film Classification (for further information go to www.bbfc.co.uk); or It is a current newsreel which has not been submitted to the British Board of Film Classification, or In the absence of a BBFC classification the film has received a recommendation on the admission of children in advance from the licensing authority who will have had regard to the BBFC classifications.                              

  28.              Where films are classified by the film classification body, (British Board of Film Classification) I will make sure that children (persons under 18) are only admitted in accordance with the classification of the film:  U - Universal - suitable for audiences aged 4 years and over; PG - Parental Guidance - some scenes may be unsuitable for young children; 12A - viewing by persons aged 12 years or older or persons younger than 12 when accompanied by an adult; 15 - viewing by persons aged 15 years and over; 18 - viewing by persons aged 18 years and over;              

   

  Conditions agreed through mediation with Ipswich Borough Council’s Environmental Protection team

   

  1.              I will make sure that noise or vibration is not noticeable at the façade of any noise sensitive premises and/or residential properties including periodic monitoring.

   

  2.              External lighting shall be installed at the licensed premises in order to promote the   licensing objectives and I shall liaise with the appropriate Environmental Services department to ensure that any lighting is positioned and of such design so as to minimise the risk of causing public nuisance by light pollution.
