Annex 2 - Conditions consistent with the Operating Schedule
Conditions offered by the Applicant
General
1. We will ensure that any person selling alcoholic drink under the Authority of a Personal Licence Holder ask for a photo ID proof of age where they have reason to suspect that the individual maybe under 18 years of age
Prevention of Crime and Disorder
1. We will ensure that public notices about Crime and Disorder issues are displayed at the request of the Council and Suffolk Constabulary
2. We will display any conditions of entry to the premises in the vicinity of the entrance
3. We will install video/CCTV equipment inside the premises and ensure that it is maintained in working order and will put up notices advising that CCTV has been installed on the premises so they are clearly visible to the public within the licensed premises
Public Safety
1. We will make sure that we have a valid Public Liability Insurance in force and that a copy of the schedule is available for inspection by an authorised officer on request
2. External lighting will be installed and maintained at the licensed premises and positioned so as to minimize the risk of causing Public Nuisance by light pollution
Prevention of Public Nuisance
1. We will provide adequate and suitable lidded receptacles to receive and store refuse from the premises and will make sure they are maintained in a clean condition
2. We will make sure litter is regularly cleared from the vicinity of the premises
Protection of Children from Harm
1. We will comply with the retailer alert bulletins issued by Portman Group.
2. A Crime Prevention Policy agreed by the Police and Local Authority will be in place
3. We will implement a Proof of Age Policy and will ensure an adequate risk assessment is in place with regard to the Protection of Children from Harm whilst they may be present on the premises and whilst licensable activities are taking place - Such assessment to be produced to an authorised officer on demand.
Conditions consistent with the Operating Schedule Tool Kit
CONDITIONS RELATING TO THE PREVENTION OF CRIME AND DISORDER
CCTV & Communication
1. I will install Video/CCTV equipment inside/outside the premises and ensure that it is maintained in working order.
2. I will set Video/CCTV equipment to record from the time that the premises open to the public until the premises close and all members of the public have left.
3. I will ensure that recordings are retained for at least twenty eight days and that copies in a viewable format are produced to an authorised officer on demand.
4. I will put up notices advising that CCTV has been installed on the premises so that they are clearly visible to the public within the licensed premises.
5. I will keep auditable records relating to the operation of the CCTV system and staff training in this respect
Proof of Age Cards
6. I will ensure that any person selling or supplying alcoholic drink under the authority of a personal licence holder asks for a photo ID proof of age where they have reason to suspect that the individual may be under 18 years of age.
Drinks Promotions
7. I shall not permit any irresponsible drinks promotions at the licensed premises which may negatively impact on the promotion of the licensing objectives.
Prohibited Substances
8. I will implement a policy agreed by the Police and local authority (for more information on this you can refer to the “Safer Clubbing Guide”)
Notices
9. I shall ensure that public information notices about crime and disorder issues are displayed at the request of the Council or the Suffolk Constabulary. (e.g. Customer Code of Conduct)
10. I will display any conditions of entry to the premises in the vicinity of any entrance to the premises.
Litter and Waste
11. I will be responsible for the disposal of waste on the frontage of the premises and make provision for the emptying of litter bins in the vicinity of the premises
Lighting
12. I will ensure that lighting is provided outside the premises (and in my private car park) during the hours of darkness when any licensable activity takes place on the premises
CONDITIONS RELATING TO PUBLIC SAFETY
Public Liability Insurance
13. I will make sure that I have valid public liability insurance in force and that a copy of the schedule is available for inspection by an authorised officer on request.
CONDITIONS RELATING TO THE PREVENTION OF PUBLIC NUISANCE
Light pollution
14. External lighting shall be installed and maintained at the licensed premises in order to promote the licensing objectives and I shall liaise with the appropriate Environmental Services department to ensure that any lighting is positioned and of such design so as to minimise the risk of causing public nuisance by light pollution.
Litter
15. I will provide adequate and suitable (lidded) receptacles to receive and store refuse from the premises/site
16. I will make sure that receptacles for refuse storage are maintained in a clean condition.
17. I will make sure litter is regularly cleared from the vicinity of the premises
CONDITIONS RELATING TO THE PROTECTION OF CHILDREN FROM HARM
General
18. I will comply with Retailer Alert Bulletins issued by Portman Group Note: This condition may be appropriate for licensed premises selling alcohol products in a manner that may appeal to or attract minors.
19. A crime prevention policy agreed by the police and local authority will be in place;
20. I will implement a proof of age policy agreed by the police and local authority; Note: Proof of age cards are dealt with in the pool of conditions relating to the crime and disorder objective. However, it may be appropriate to consider the production of proof of age cards to ensure that appropriate checks can be made where the presence of children is restricted by age at certain time.
21. I will ensure an adequate risk assessment is in place with regard to the protection of children from harm whilst they may be present on the premises and while licensable activities are taking place. Such risk assessment to be produced to an authorised officer on demand.
Conditions agreed through mediation with the applicant and Suffolk Constabulary
1) The licence holder shall operate and maintain a refusals register in respect of declined sales of alcohol where the attempted purchaser was suspected of being under 18 years of age or drunk. The refusals register shall be kept on the premises and be made available immediately upon request to an authorised officer of the Police or Local Authority.
2) The licence holder will ensure that within six weeks * of any appointment of a member of staff, they receive training to BIIAB Responsible Alcohol Retailing standards or equivalent. A training record will be kept at the premises, which will be made available immediately upon request to an authorised officer of the Police or Local Authority.
3) CCTV WILL be provided in the form of a recordable system, capable of providing pictures of EVIDENTIAL QUALITY in all lighting conditions particularly facial recognition.
Cameras shall encompass all ingress and egress to the premises and all areas where the sale / supply of alcohol occurs.
Equipment MUST be maintained in good working order, be correctly time and date stamped, recordings MUST be kept in date order, numbered sequentially and kept for a period of 28 days and handed to Police on demand.
The Premises Licence Holder must ensure that at all times the DPS and all appointed members of staff are capable and competent at downloading CCTV footage in a recordable format EITHER DISC or VHS to the Police/Local Authority on demand.
The Recording equipment and tapes/discs shall be kept in a secure environment under the control of the DPS or other responsible named individual.
An operational daily log report must be maintained endorsed by signature, indicating the system has been checked and is compliant, in the event of any failings actions taken are to be recorded.
In the event of technical failure of the CCTV equipment the Premises Licence holder/DPS MUST report the failure to the Police on contact number 01473 613888 immediately.
4) Staff records with regards to Licensing accreditations and training shall be kept on the premises and produced to the Police and Authorised Local Authority Licensing Officers on demand.
5) The store will not retail any high strength beer / cider / lager with an ABV greater than 6.5%.
