  Where licence authorises the supply of alcohol

   

  1.              No supply of alcohol may be made under the premises licence-

  (a) at a time when there is no designated premises supervisor in respect of the premises licence, or

   

  (b)               at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.              Every supply of alcohol under the premises licence must be made or authorised by a               person who holds a personal licence.

   

  Door Supervision

   

  Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority.

   

  Where the licence authorises the exhibition of Films

   

  1.              The admission of children to the exhibition of any film must be restricted in accordance with this section.

   

  2.              Where the film classification body is specified in the licence, unless subsection (3) (b) applies, admission of children must be restricted in accordance with any recommendation made by that body.

   

  3.              Where-               (a)               the film classification body is not specified in the licence, or

  (b)               the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  4.              In this section- "children" means persons aged under 18; and "film classification body" means the person or persons designated as the authority  under section 4 of the Video Recordings Act 1984 (c.39)  (authority to determine suitability of video works for classification).

   

  Conditions effective from 1st October 2010

   

  1.              (1)               The premises licence holder or club premises certificate holder shall ensure               that an age verification policy applies to the premises in relation to the sale or               supply of alcohol.

  (2)               The policy must require individuals who appear to the responsible person to be               under 18 years of age (or such older age as may be specified in the policy) to               produce on request, before being served alcohol, identification bearing their               photograph, date of birth and a holographic mark.

   

   

• Annex 2 - Conditions consistent with the Operating Schedule

  Conditions offered by the Applicant

   

  General

   

  1.              Training of all staff in the premises to ensure that they understand and adhere to the law relating to the sale of alcohol

  2.              Refresher training will be given on a regular basis and training records will be kept and made available to Police or Council officials on request

   

  The Prevention of Crime and Disorder

   

  1.              CCTV installed that meets the standards required by the Police and maintained so fully operational at all times

  2.              Recordings to be kept in accordance with Police guidelines for a minimum of 30 days and to be made available to Police/Council officers if required

  3.              Alarm system in place

  4.              Shutters at front windows

   

  Public Safety

   

  1.              All staff trained to deal with any outbreak of fire at the premises

  2.              Fire extinguishers installed and regularly serviced in accordance with fire authority guidelines

  3.              To comply with any requirements of the Fire Authority

   

  The Prevention of Public Nuisance

   

  1.              Anyone who is drunk or under 18 or appears to be buying alcohol for someone who is drunk or under 18 will be refused the sale of alcohol

   

  The Protection of Children from Harm

   

  Conditions agreed through mediation with Suffolk Constabulary

   

  1.              CCTV shall be provided in the form of a recordable system, capable of providing pictures of evidential quality in all lighting conditions particularly facial recognition. Cameras shall encompass all ingress and egress to the premises and all areas where the sale/supply of alcohol occurs. Equipment must be maintained in good working order, be correctly time and date stamped, recordings must be kept in date order, numbered sequentially and kept for a period of 28 days and made available to Police on demand. The Premises Licence Holder must ensure at all times a DPS or appointed member of staff is capable and competent at downloading CCTV footage in a viewable format on disc or storage device to the Police/Local Authority within 36 hours of a request. The Recording equipment and discs shall be kept in a secure environment under the control of the DPS or other responsible named individual. An operational daily log report must be maintained endorsed by signature, indicating the system has been checked and is compliant. In the event of any failings; actions taken are to be recorded in the log.

   

   

  2.              All staff engaged in the sale of alcohol to be trained in Responsible Alcohol Retailing to the minimum standard of BIIAB level 1 or equivalent, within three months of commencing employment at the premises. Training records shall be kept on the premises and produced to the Police and authorised Local Authority Licensing Officers on demand. For the avoidance of doubt this training can be administered in-house in accordance with the relevant criteria. Training shall be reviewed annually to ensure staff are up to date with the latest legislation.

  3.              To enhance the mandatory condition relating to an age verification policy, the premises licence holder will implement the ‘Challenge 25’ scheme, ensuring prominent signage is displayed throughout the premises and all staff are trained in its operation.

  4.              To only purchase stock from an authorised wholesaler and produce receipts upon request for inspection (an authorised wholesaler means an established warehouse or outlet with a fixed address and VAT registration).

  5.              Not to purchase any stock from any mobile supplier calling at the business to offer their services, or from any trader operating from a van or temporary business accommodation.

  6.              To keep alcohol and tobacco receipts on Premises for a minimum of six months to be produced to Suffolk Police, Suffolk Trading Standards, HMRC or Ipswich Licensing Authority upon request.

  7.              The Licence holder shall operate and maintain a refusals register in respect of declined sales of alcohol where the attempted purchaser was suspected of being either under 18 years of age or someone who was already drunk. The refusals register shall be kept on the premises and is to be made available on demand to Police or the Local Authority.

   

  Conditions agreed through mediation with Suffolk Constabulary & Public Health

   

  1.              No Super Strength Lagers, Beers or Ciders - (6.5% alcohol by volume or above) are to be sold from the premises
