  Where licence authorises the supply of alcohol

   

  1.                            No supply of alcohol may be made under the premises licence-

  (a)               at a time when there is no designated premises supervisor in respect of the               premises licence, or

  (b)               at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Door Supervision

   

  Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority.

  Where the licence authorises the exhibition of Films

   

  1.              The admission of children to the exhibition of any film must be restricted in accordance with this section.

   

  2.              Where the film classification body is specified in the licence, unless subsection (3) (b) applies, admission of children must be restricted in accordance with any recommendation made by that body.

   

  3.              Where-               (a)               the film classification body is not specified in the licence, or

  (b)               the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  4.              In this section- "children" means persons aged under 18; and "film classification body" means the person or persons designated as the authority  under section 4 of the Video Recordings Act 1984 (c.39)  (authority to determine suitability of video works for classification).

   

  The Licensing Act 2003 (Mandatory Licensing Conditions)

  (Amendment) Order 2014

   

  1.                (1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises-

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-

  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;

  (d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

  (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

   

  2.                The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

   

  3.                (1)  The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

  (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-

  (a) a holographic mark, or

  (b) an ultraviolet feature.

   

  4.                The responsible person must ensure that-

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml;

  (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

  (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

   

   

   

   

   

   

   

   

  Conditions as specified by order of the Secretary of State under S19A of the Licensing Act 2003

   

  Conditions effective from 28th May 2014

   

  (1)              A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

  (2)              In this condition:-

  (a)              “permitted price” is the price found by applying the formula P = D + (D x V), where-

  (i)              P is the permitted price,

  (ii)              D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  (iii)              V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

  (b)              “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

  (c)              “relevant person” means, in relation to premises in respect of which there is in force a premises licence-

  (i)              the holder of the premises licence,

  (ii)              the designated premises supervisor (if any) in respect of such a licence, or

  (iii)              the personal licence holder who makes or authorises a supply of alcohol under such a licence;

  (d)              “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

  (e)              “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.

  (3)              Where the permitted price would not be a whole number of pennies, the permitted price shall be taken to be the price rounded up to the nearest penny.

  (4)              1) Where the permitted price on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.

  2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

   

   

• Annex 2 - Conditions consistent with the Premises Operating Schedule

   

  Conditions offered by applicant in relation to the 4 licensing objectives

   

  CCTV:

   

  1.              The Premises Licence Holder or Designated Premises Supervisor shall install and maintain a comprehensive CCTV system to the satisfaction of an authorised employee of Suffolk Constabulary. All entry and exit points must be covered enabling frontal identification of every person entering

   

  2.              The Premises Licence holder shall ensure that the CCTV system shall continually record whilst the premises is open for licensable activities and during all times when customers remain on the premises. All recordings shall be stored for a minimum period of 31 days with date and time stamping

   

   

  3.              Recordings shall be made available immediately upon the request of the Police or authorised officer of the Local Authority providing such requests are in connection with the prevention or detection of crime. Recordings are to be supplied in the form of digital download

   

  4.              A staff member from the premises who is conversant with the operation of the CCTV system shall be on the premises at all times when the premises is open to the public. This staff member shall be able to show Police or an authorised officer of the Licensing Authority recent data or footage with the minimum delay when requested

   

  5.              All faults/defects in the CCTV system must be reported to Suffolk Constabulary immediately the fault is discovered. The notification must be made to the Suffolk Constabulary non-emergency telephone number 101 and a log number obtained from the Police and recorded in the incident book. The Suffolk Constabulary Licensing Unit must also be notified as soon as reasonably practicable

   

  6.              All faults with the CCTV system shall be repaired as soon as possible and in any case within 5 working days

   

  Security:

   

  1.              A minimum of 2 SIA licensed door supervisors shall be on duty at the premises on Fridays, Saturdays and Bank Holiday Sundays, or for any event for which a risk assessment has been requested by Suffolk Constabulary, from 21.00 until 30 minutes after licensable activity ceases

   

  2.              The SIA staff will be on duty at the entrance to the venue

   

  3.              A register will be maintained of SIA staff on duty. The register must be completed each time staff report for duty. The register will show the name and SIA number of the staff member concerned. Each entry in the register will be maintained for a period of 12 months and must be made available immediately upon the request of Police or authorised officer of the Local Authority

   

  4.              All persons entering or re-entering the premises shall be searched by an SIA trained member of staff as a condition of entry/re-entry whist SIA staff are in operation

   

  General:

   

  1.              A log (which may be electronically recorded) shall be kept detailing all refused sales of alcohol. The log should include the date and time of the refused sale and the name of the member of staff who refused the sale. The log shall be available for inspection at the premises by the Police or an authorised officer and must be made available on request. The log will be kept for 12 months from the date of each entry

   

  2.              An incident log shall be kept at the premises for at least 12 months and made available on request to an authorised officer of the Local Authority or the Police, which will record the following:

  a)              All crimes reported to the venue or by the venue to the Police

  b)              All ejections of patrons

  c)              Any complaints received

  d)              Any incidents of disorder

  e)              Seizures of drugs, offensive weapons, fraudulent ID or other items

  f)              Any faults in the CCTV system or searching equipment or scanning equipment

  g)              Any visit by a relevant authority or emergency service

   

  3.              A TOWNLINK (or other approved system) radio must be available for use by staff trained in its use at all times the premises are open to the public. The radio will be kept in good working order, monitored by a responsible member of staff and used to report incidents of crime and disorder to the CCTV control room or Police

   

  4.              The Designated Premises Supervisor or his/her nominated deputy shall ensure that tables are cleared of all bottles and glasses on a regular basis during trading hours to avoid an accumulation of glassware/drinking vessels

   

  5.              The Designated Premises Supervisor must be employed at the premises and be responsible for its day to day management. When the DPS is away from the premises for a significant time - for example on holiday - a ‘nominated deputy’ must be appointed and details recorded in the incident book. The nominated deputy is to be available upon request by Police

   

  6.              All staff concerned in the supply of alcohol will be trained to at least the level required to hold a personal licence under the Licensing Act 2003 within 4 weeks of employment. This training may be conducted in house but must be recorded in a log. Refresher training will be carried out for all staff every 3 months. The training records must be maintained for at least 12 months for each entry and shall be available for inspection at the premises by the Police or an authorised officer and must be made available on request

   

  7.              There will be no admission or re-admission to the premises 30 minutes before licensable activity is due to cease

   

  Prevention of Crime and Disorder:

   

  1.              There shall be a policy agreed with Suffolk Constabulary and approved by an authorised officer of the Licensing Authority for the premises relating to illegal drugs found on persons or on the premises

   

  2.              A clearly visible notice shall be placed at each entrance to the premises advising those attending that it is a condition of entry that customers agree to being searched and that the Police will be informed if anyone is found in possession of controlled substances or weapons

   

   

  3.              Hourly checks will be made of all public areas including toilets to detect the use of illegal drugs during SIA hours. All visits will be recorded in an incident book, which shall be available for inspection at the premises by the Police or an authorised officer of the Local Authority and must be made available on request. The log will be kept for 12 months from the date of each entry

   

  4.              A queuing system for entry to the venue is to be implemented on any occasion that SIA supervisors are employed at the venue

   

   

   

   

  Public Safety:

   

  1.              There shall be a policy agreed with Suffolk Constabulary and approved by an authorised officer of the Licensing Authority for the premises relating to unlawful weapons being used by customers

   

  2.              No glasses, bottles, or other drinking vessels to be taken onto the street outside the front of the venue by customers at any time

   

  3.              At least 21 days before any ‘significant event’ is held at the premises, the Designated Premises Supervisor must serve on the Suffolk Constabulary licensing unit a Suffolk Constabulary approved risk assessment form:

  A ‘significant event’ is an event that is:

  a.              Promoted/advertised to the public at any time before the event, and

  b.              Predominantly features ‘DJs’ or ‘MCs’ performing to a recorded backing track, unless the DJs are already risk assessed by Suffolk Constabulary. The PLH/DPS or designated deputy will be responsible for providing details and

  c.              Is provided between the hours of 10pm and 4am

   

  4.              The DPS/nominated deputy is to be responsible for the bookings of all ‘significant events’ at the premises

   

  Prevention of Public Nuisance:

   

  1.              Signage will be clearly displayed at all exit points to advise customers that they must leave the venue quietly

   

  2.              Doors and windows are kept closed (except for ingress and egress) to reduce noise nuisance from the premises whenever live music or DJs are in operation

   

  3.              The placing of bottles into receptacles outside the premises will take place before 11pm or after 7am

   

  Protection of Children from Harm:

   

  1.              There shall be a policy agreed with Suffolk Constabulary and approved by an authorised officer of the Licensing Authority for the premises on the handling of fraudulent identification used to obtain the sale of alcohol

   

  2.              Clearly visible signage is to be displayed at the entrances and at points of sale indicating it is illegal to sell alcohol to people under the age of 18

   

  3.              The premises must implement a ‘Challenge 25’ Policy, whereby all customers who appear to be under 25 must produce photographic identification in the form of a passport, driving licence or proof of age scheme (PASS) approved identification before being allowed to purchase alcohol

   

  Annex 3 - Conditions attached after a hearing by the licensing authority

  Conditions effective from 1st October 2010

   

  1.              (1)               The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

  (2)               The policy must require individuals who appear to the responsible person to be               under 18 years of age (or such older age as may be specified in the policy) to               produce on request, before being served alcohol, identification bearing their               photograph, date of birth and a holographic mark.

   

  2.              The responsible person shall ensure that–

  (a)               where any of the following alcoholic drinks is sold or supplied for               consumption on the premises (other than alcoholic drinks sold or               supplied having been made up in advance ready for sale or supply in a               securely closed container) it is available to customers in the following measures–

  (i)               beer or cider: ½ pint;

  (ii)               gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii)               still wine in a glass: 125 ml; and

  (b)              customers are made aware of the availability of these measures.
