CONDITIONS RELATING TO THE PREVENTION OF CRIME AND DISORDER
CCTV & Communication
1 1. | I will put up notices advising that CCTV has been installed on the premises so that they are clearly visible to the public within the licensed premises. |

2.I will ensure that the consumption of alcohol is restricted to the areas identified on the plan attached to the operating schedule. | |

CONDITIONS RELATING TO THE PROTECTION OF CHILDREN FROM HARM
Access for children to licensed premises generally
6. | I will require that children under the age of 12 are accompanied by adults after 11pm in the evening. Note: The above condition may be appropriate for any premises NOT serving alcohol for consumption on the premises, but where the public are allowed on the premises after 11pm in the evening. Applicants wishing to allow access to premises to unaccompanied children under the age of 12 after 11pm should address in their operating plan their reasons and explain the steps that they intend to take to protect children from harm. |
Conditions agreed through mediation with Ipswich Borough Council’s Environmental Protection department
Noise from the premises shall not be noticeable above background levels at the nearest noise sensitive location.
Conditions agreed through mediation with Ipswich Borough Council’s Occupational Health & Safety department
At all times the premises (or relevant part of the premises) is open to the public for licensable activities we will ensure that the sanitary installations comply fully with the relevant parts of:
BS 6465-1:2006+Amendment 1:2009 Sanitary Installations. Code of practice for the design of sanitary facilities and scales of provision of sanitary and associated appliances.
Conditions agreed through mediation with Suffolk Constabulary
1. Entry to Switch Nightclub must be through Switch Nightclub main entrance.
2. When capacity levels at Switch nightclub necessitate the opening of the overflow area in the Malthouse, clickers or other such counting devices will be used on entry and migration to or from each venue to ensure capacity levels are not breached.
General - All four licensing objectives
1. Polycarbonate / plastic containers shall be used at all times when the premises operate for licensable activities. In the event that polycarbonate / plastic bottles cannot be provided, then all bottled drinks will be decanted and served in polycarbonate / plastic containers at point of sale. Permissible exceptions will be large capacity Champagne bottles inclusive and in excess of 75cl, served and contained within the VIP area, for table service, closely supervised by a member of staff.
2. Where a non standard event is planned, management will risk assess the need for polycarbonate drinking vessels. A written copy of the risk assessment must be submitted for approval to the Licensing Authority and the police, no later than 10 working days prior to the event.
3. A search policy shall be implemented. All patrons shall be subject of a search involving a metal detecting device on entry to the venue. All persons suspected of possessing prohibited articles will be searched upon entry. All bags will be searched. Metal detecting equipment to be kept in working order and used at all times when Premises operate for licensable activities.
4. That by use of either a police approved radio system, the 999 service or other non-emergency number, all instances of ejection of persons from the premises must be notified to the Police at the time of happening or as soon as possible thereafter. Where an offence has been committed the door supervisors or premises management will retain the offender for hand over to the Police or will take all reasonable steps to identify the offender and pass the identity to the Police as soon as is reasonably practicable.
5. All instances of drunkenness, disorder, drug use or violence will be challenged, resulting in the refused admission, ejection or retention of the individual(s) and under serious circumstances, consideration shall be given to their permanent exclusion from the premises in future.
6. All individuals, without any exception, subject to a court exclusion ban will be refused entry and excluded from the premises for the entire duration of their ban. All staff will be alerted to the banned persons and report any attempt that such persons make to gain access to the premises to the Police.
7. The capacity in the premises shall be recorded by ticket/admission sale records, clicker, or other such counting device, The results of which shall be made available to an Authorised Officer of the Licensing Authority or Police on request and should be retained for a minimum of 60 days.
8. A written dispersal policy, agreed by the police, will be in place and adhered to.
9. A written drugs policy, agreed by the police, will be in place and adhered to.
10. Signage, Characters in not less than 32 font, shall be clearly displayed prominently at the point of access, toilet areas and exits in relation to Age Policy, Drug Policy and Dispersal Policy.
11. The sale and supply of alcohol shall cease no later than sixty minutes prior to the time the premises close.
12. Final entry to the premises is fixed at 0200 Monday to Saturday and 0100 on Sunday
13. The premises license holder will provide on the licensed premises a lockable secure deposit box with secure key system, to retain any confiscated items and will notify the police of any items requiring items requiring safe disposal, within 48 hours of such item being confiscated
14. A receptacle disposal bin will be sited adjacent to the main access / egress door to facilitate Item disposal.
15. The receptacle bin and the secure deposit boxes will be emptied weekly and the DPS will be responsible for maintaining the integrity of the keys. Key holder records will be maintained and provided to the police and/or licensing authority representative on request.
The Prevention of Crime and Disorder
1. There will be crowd dispersal plans in place including a taxi booking service.
2. The Licensee will be a member of Pubwatch.
3. CCTV shall be provided in the form of a recordable system, capable of providing pictures of evidential quality in all lighting conditions. Facial recognition must be possible. Cameras shall encompass all ingress and egress to the premises, fire exits, outside areas, including exterior aspects of the building and all areas where the sale / supply of alcohol occurs. Notices that CCTV has been installed will be clearly visible to the public within the licensed premises. Equipment MUST be maintained in good working order, be correctly time and date stamped, recordings MUST be kept in date order, numbered sequentially and kept for a period of 30 days and made available to Police on demand. The Premises Licence Holder must ensure at all times a DPS or appointed member of staff is capable and competent at downloading CCTV footage in a viewable format on disc or storage device to the Police / Local Authority within 36 hours of a request. The Recording equipment and discs shall be kept in a secure environment under the control of the DPS or other responsible named individual. An operational daily log report must be maintained endorsed by signature, indicating the system has been checked and is compliant, in the event of any failings; actions taken are to be recorded. In the event of technical failure of the CCTV equipment the Premises Licence holder/DPS shall report the failure to the Police and Licensing Authority immediately.
4. The DPS shall ensure the premises are subscribed to a police approved radio system. The radio will be kept in working condition by testing daily and used while the premises open for licensable activities.
5. The Premises will participate in and adhere to Suffolk Constabulary’s Promotional Event Risk Assessment scheme.
Public Safety
1. The volume of music will be reduced discernibly thirty minutes prior to the premises closing. The music will be less dance orientated and played with a continually reduced volume to encourage customers to leave the premises in a staged manner.
2. It shall be the DPS’s responsibility to ensure that all staff are clearly instructed to not allow any drinking vessels to be removed from the premises by customers. For the avoidance of doubt, no alcohol will be permitted outside the premises either by off-sale or for consumption. Empty drinking vessels shall be regularly collected so as to ensure no accumulation in areas where the public have access and any activities such as the taking out of refuse; including glass bottles, must NOT be carried out between 2300hrs and 0700hrs.
3. No persons under the age of 18 will be permitted entry to the nightclub unless the event is specifically aimed at under 18’s. Any event aimed specifically at under 18’s will ensure no alcohol is displayed for sale. Persons under the age of 18 are permitted on the events premise, while the premises are open for licensable activities when accompanied by a responsible adult. No person under the age of 14 shall be permitted in the bar area of the licensed premises unless one of the following applies:
(a) He/she is the child of the holder of the premises licence,
(b) He/she resides in the premises, but is not employed there,
(c) He/she is in the bar solely for the purpose of passing to or from some part of the premises which is not a bar and to or from which there is no other convenient means of access or egress.
4. Fire drills will be carried out.
5. Complete First aid kits must be located on each floor of the premises and be readily available to all staff at all times. The Kits will be inspected daily and replenished daily if required. An endorsed log sheet will be contained in each kit. An accredited first aid trained person MUST be on duty at all times when premises operate for licensable activities.
The Prevention of Public Nuisance
1. Security staff will ensure that all patrons have left the premises prior to signing off duty.
2. A food service will be available throughout the venue. Any waste or litter, including smoking related litter, at the perimeter of the licensed premises shall be cleared once every 24hrs at the close of business. Adequate smoking related litterbins shall be provided at the front entrance and smoking areas of the premises and these shall be emptied on a daily basis.
3. The premises will supply a free taxi booking service for the use of customers leaving the premises.
The Protection of Children from Harm
1. The Challenge 25 policy will be in place and adhered to throughout the premises and only Home Office approved forms of identification will be accepted as proof of age.
2. An incident book shall be kept and maintained on the premises at all times. The book shall detail, incident of injury/ejection/refusals/drug misuse/seizure/age challenge. Such matters shall be timed, dated and signed by the author and produced to Authorised Licensing Officers/Police Officers on demand.
3. A Personal Licence Holder shall be on duty on the premises at all times when the premises operate the sale and supply of alcohol.
4. Staff training records shall be kept on the premises and produced to the Authorised Licensing officer/ Police Officers on demand.
Further conditions mediated with Suffolk Constabulary and imposed by Licensing Sub-committee
1. To prohibit a style of music that may create an atmosphere of violence or may promote discriminatory, racist, homophobic or inflammatory behaviour within its lyrics
2. To prohibit a style of music that tends to glamorise violence and gun culture within its lyrics
3. Door staff will attend regular training sessions, particularly those offered by the police or local authority, concerning searching, drugs awareness, weapon awareness and general safety.
4. A Smoking Policy covering the use and management of the smoking area, agreed by the police, will be in place and adhered to.
5. That cameras coving the exterior of the premises will be left to record for a period of not less than 1 hour after the premises have closed.
Annex 3 - Conditions attached after a hearing by the licensing authority
1. Minimum of 6 door supervisors will be present per venue (12 door supervisors when both venues operate together) when licensable activities are taking place to ensure all licensable objectives are being met. At least one door supervisor per venue will be female (at least 2 door supervisors will be female when both venues operate together). Door supervisors will complete an attendance book at the beginning of each shift. This will include their full name and full SIA licence number
2. Where a non standard event is planned, management will risk assess the required number of SIA registered door supervisors. A written copy of the risk assessment must be submitted for approval to the Licensing Authority and the police, no later than 10 working days prior to the event.
