Annex 2 - Conditions consistent with the Premises Operating Schedule
Conditions offered by applicant
General
At first floor level in the more traditional restaurant style area, waiter/waitress service will be the service option available to customers
Food will be available throughout the trading day on both floors of the premises
The stipulated timings for the retail sale of alcohol shall not after those times:
1. Prohibit the consumption of alcohol on the premises by persons who have purchased the alcohol before the terminal hour
2. Prohibit the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the alcohol is supplied at the expense of their employer or of the person carrying on, or in charge of, the business on the premises; and
3. Prohibit the supply of alcohol for consumption on the premises to any private friends of the person carrying on, or in charge of, the business on the premises, providing those private friends are bona fide entertained by that person at his own expense
The Prevention of Crime and Disorder
It is implicit that the Premises Licence holder will ensure compliance with Part 7 of the Licensing Act 2003
Public Safety
The occupancy level for both floors including staff will not exceed 110 at any one time
Reference is made to the drawings submitted with the application which become part of the premises licence showing safety aspects incorporated into the design, including fire safety
The Prevention of Public Nuisance (applied at variation stage)
Voluntary pubwatch membership will be maintained and the Portman Code of Conduct with strict adherence to the ‘Challenge 21’ policy
The premises licence holder will continue to ensure that staff and the Designated Premises Supervisor are fully trained and conversant with the Licensing Laws
The Protection of Children from Harm
It is implicit that the Premises Licence holder will ensure compliance with Part 7 of the Licensing Act 2003
Conditions agreed with Police
Management and staff of the premises are to ensure that customers do not remove open bottles or glasses from the premises by way of the front door leading on to Lion Street, Ipswich, for the purposes of consuming the beverage outside

The Prevention of Public Nuisance
I will make sure that noise or vibration is not noticeable at the façade of any noise sensitive premises
I will display prominent, clear and legible notices at all exits requesting patrons to respect the needs of local residents and to leave the premises and the area quietly
I will make sure that during the final 30 minutes of opening the music is discernibly quieter
I will make sure that any request by an authorised officer of the Council or Police Officer in relation to reducing noise levels is complied with
Conditions agreed through mediation with Suffolk Police Constabulary at variation stage (September 2010)
The Prevention of Crime and Disorder
Door Supervision
1. The premises will not operate with less than 2 SIA registered door staff from 20.30hrs on nights when DJ based Events are taking place to ensure that:-
i. Drunk and disorderly persons are refused admission to/ejected from the premises without causing further disorder.
ii. Excluded individuals (subject of Court or Pubwatch bans) are prevented from entering the premises.
2. A searching Policy agreed with the Police is to be put in place by the holder of the premises licence.
3. All Door Supervisors to be SIA licensed and to display license clearly and openly with use of a fluorescent armband for this purpose.
4. Door Supervisors will maintain a signing on register, and Incident book. This must be audited and made available to the Police or representative of the Licensing Authority on request.
Communication
1. The premises will be a member of the Police and Local Authority approved radio scheme (Currently Townlink/Leisure-Link and operated by Ipswich Central) to provide a communication system between the Police, Local Authority CCTV and other users of the system.
2. The radio scheme shall be actively monitored and used during licensable activity when Door Supervisors are required.
3. Doorstaff must also have a radio system to allow internal communication (in addition to the Police/Local Authority approved radio)
CCTV
1. Digital CCTV shall be used in the premises.
2. CCTV shall comply with the UK Police Requirements for Digital CCTV systems.
3. A member of staff will be available on the premises during all opening hours that is trained and able to download images from the CCTV System.
4. CCTV images shall be kept for a minimum of 21 days and available to Police and the Licensing Authority upon request.
5. The CCTV shall be maintained in good working order, monitored during licensable activity and cover those areas of the premises agreed by the police.
Training
1. Fully auditable training records should be maintained for all staff in respect of the sale of alcohol. These will be made available for inspection upon request to the Police and all other Responsible Authorities
